Jim Duensing is an attorney and legally an “Officer of the Court” and his resisting an arrest may be enough to get him disbarred. Just because he does not want to be arrested is no excuse for not complying with this lawful order by the police. As an attorney he was aware of the penalties for resisting arrest. He was not shot for a traffic violation. He was a prisoner, under arrest, attempting to escape. Shooting a prisoner attempting to escape, regardless of convictions or charges against them, is within the general boundaries for use of deadly force.The officer then had some options as to what force to administer to bring Duensing to jail. No matter what shortcomings are found with the police officers actions Duensing by his own words is responsible for his getting shot.
