I'm pretty sure if he is warned and continues being disruptive the defendant can be removed and the trial can continue without him. I can't imagine anyone thinking duct tape is an appropriate solution.

Have people forgot what cruel means? When I was in grade school we had a teacher that would tape the mouths shut of talkative students. I learned to shut the hell up. Torture is cruel, sleep deprivation maybe cruel, duct tape not cruel.

God this country has become so full of pussies it's pathetic. Back in the old days they would of had the bailiff take the guy to the broom closet and show him how to shut the f**k up. Maybe that was an overreaction, maybe it was unnecessary. Now you guys think tape over the mouth is cruel and unusual. What's next? Orange jump suits are damaging to the eyes?
