Wait, what? The Pirate Bay founders run a site that hosts illegal music and videos. The site even has "pirate" in the damn name. They're guilty. Can we get back to reality please, Digg.

You've got to understand how the Italian justice system works. They don't have a popular jury, they have judges who listen to the arguments of the parts and then deliver their verdict according to a strict set of laws. There is no "precedent" at all. Moreover, while the defence is just represented by an attorney, the prosecutor is another judge. The prosecution is heavily favoured, and more often than not the judge who oversees the trial has already made up his/her mind and will simply fit the evidence in to support his or her theory. If they already decided TPB is guilty, then it is guilty and no amount of evidence to the contrary or fine debating will change the outcome.

TPB was charged with *assisting* copyright infringement, not committing it themselves, so the question of where files are actually hosted was never an issue. And since they undoubtedly helped plenty of Italians commit copyright within Italy's borders, they can easily be charged there as well.
