As admin for ubbdev, we had lots of smilies created at our site and used by our members (after they properly downloaded and re-upped to their own site). In checking log files I noticed a HUGE amount of bandwidth going to sites who hosted free forums (the web 1.0 version of myspace). The smilies were usually 15x15 pixels, so we htaccessed them to this nice 1000x1000 pixel image:<a class="user" href="http://www.ubbdev.com/ubbart/avatars/16.gif">http://www.ubbdev.com/ubbart/avatars/16.gif</a>I had a few people threaten me with lawsuits for wrecking their sites, I threatened to counter-sue for stealing intellectual property and bandwidth and I never heard from them again ;)

Actually, there is legal precedent in several cases regarding "hotlinking" of images from other sites, hosting other peoples' content in a frame, or otherwise re-purposing copyrighted content in your own work. People have even taken Google to task on this one (which is dumb, since they'll remove your content if you just ask).Given proper attribution, the usage would be governed by the same 'fair use' clauses as any copyrighted material, but if the author is not credited, and/or the resulting work is used for commercial purposes, you could get busted.So yes, it *is* illegal.
