He doesn't have to. Which makes all of the actions of the officer illegal. Here's the proof. I've laid out the facts for you. The law is clear. Justice must be served.

i totally agree. and the main thing was the officer did not at any time tell him he was placing the driver under arrest. If you are being arrested for murder or for a traffic violation, you still have to tell the person that you are placing them under arrest and the charge. then he conducted an illegal search of the vehicle.

He's not resisting arrest if the police does not tell him he is being put under arrest. And again, the police must have cause for conducting the arrest.

I didn't say an assault never happened. I only said that the author misused the term, which he did. A better way of describing the "free pass" would involve the notion of immunity.And, since you stated that you are a lawyer I assume that an attorney-client relationship exists between us and will be taking what you said as legal advice and acting in reliance thereof.
