Wrong. It's 'screwed if you buy a house here' in my city. In even Nashville, TN, there is a necessity, set by the city that a PUD (Private User Something or other) or HOA be put in every new subdivision. So you have two choices: 1. Buy a crappy house in the 4th most violent city in the USA per capita- 2. Buy a house in any subdivison since the 90's and put up with a Kim Jong housewife in charge. I'm so deeply entrenched in a HOA fight right now, half the neighborhood put me up as the new prez because I'm running on the platform of "It's your friggin' house! The money is for drainage and paving issues, not messing with homeowners! As long as it doesn't look like Sanford and Son out there and you start stripping cars in your front yard, we're cool."

@MJMI completely agree with you. Some of those questions should definitely be posed to the HOA on why this is an issue now, and how is this any more of an advertisement than other magnets. They shouldn't be allowed to overstep their bounds. I won't completely criticize them until I hear there side of it, because the case presented by Fox just makes them look like morons. They should be accountable, but I'm not too quick to judge yet. They better have a good reason though if they don't want me to frown really hard at them.I only get tired of hearing the knee jerk response from many that they shouldn't have to abide by rules that some people here may not agree on - and therefore the HOA should rot in hell. That's really not the issue here, which I think you addressed with commendable accuracy.For the record, HOAs suck, but they keep the value of my property and my largest investment sound by not letting my neighbors paint their house orange and put up pink flamingos in their yard. And for that peace of mind, I'll make a few sacrifices including keeping unregistered beaters off my lawn and driveway, pull my trash in every night, and keep my house painted in no offensive colors.

Frequently, HOA covenants are made part of the deed so they become a part of what you are buying.

If you win propose ABOLISHING the HOA and all its agreements.Now if they decide to form a new one they have to CONVINCE people to sign on and they can simply abstain.That would be the ultimate victory. vote me as president of the HOA so I can get RID of the HOA :-) hehe

Huh I was not aware they could do that. I guess it means I will never buy a home under an HOA because I would rot in hell before accepting such a condition.
