Some HOA petty little rules trampling the Constitution. Take this to court to a non-liberal judge, and hopefully the HOA gets it's rule killed with extreme prejudice for being unconstitutional.Mark Twain said it best. "A gun carrying society is a polite society."
When are these type of idiots going to wake up and realize that criminals don't follow rules. Rules don't protect the innocent, they make the innocent into criminals.
Kennesaw has the nickname of "Gun Town, USA" due to a city ordinance passed in 1982 [Sec 34-1a] that requires every head of household to maintain a firearm with ammunition. It was passed partly in response to a 1981 handgun ban in Morton Grove, Illinois. Kennesaw's law was amended in 1983 to exempt those who conscientiously object to owning a firearm, convicted felons, those who cannot afford a firearm, and those with a mental or physical disability that would prevent them from owning a firearm. It mentions no penalty for its violation. According to the Kennesaw Historical Society, no one has ever been charged under the law.Criminologist and gun-control critic Gary Kleck attributes a drop of 89% in the residential burglary rate to the law (Kleck, 1991), and Kennesaw is often cited by advocates of gun ownership as evidence that gun ownership deters crime (see, for instance, this 2004 sheet of talking points from the Gun Owners Foundation).
But they knew what the rule-making rule was when they moved there. Well, I'm assuming they did. If the HOA (company) just changed the rules arbitrarily, that doesn't fly.(And yes, it's perfectly OK - or should be - to have rules about no gays, no blacks, no redheads, whatever. If you don't like the rules, don't move there! Forcing people to associate with people they don't want to associate with is just as bad as preventing them from associating with people they do want to associate with!)
I think it's ironic... Those developments are trying to appeal to/attract paranoid snobs who think they're better than everyone. I think it's absolutely fantastic that they're attracting people by offering "security" in rich little compounds, but then saying those they have attracted can't own guns. Hilarious. I always love watching the uber-sheltered suburbanites whine about something inconsequential and essentially self-inflicted.
"however, slavery is constitutionally banned and can this be exercised nowhere."There are, likely, millions of people who enjoy B&D who would disagree with you completely._Involuntary_ servitude is illegal. But if you voluntarily sign a contract or otherwise voluntarily enter into an agreement, you can be anything you want, including a slave. The problem with this situation is that the "rules" of the "home owners association" are "voluntarily" agreed to. I put it all in scare quotes because few people are worried enough about those rules to actually read them, and most associations really care most about property values, so many rules are only enforced when things get out of hand.It is very likely that the rule banning firearms was completely within the rules of the homeowners association that people signed an agreement to abide, and the only reason that people got upset was because it was a rule they didn't like this time.In most things people interact voluntarily, and can terminate that interaction when it no longer suits them. "No shirt, no shoes, no service" is a perfect example. This is very much like what happens when someone complains about their taxes. One cannot terminate the voluntary agreement without moving. They must give up their private property, which turns out not to have been really theirs because someone else could make rules about what they may and may not do with their "private" property. The answer to HOAs is not to sign them, not to buy property with them. When the houses go unsold, developers will stop requiring HOAs. Developers only instutute Home Owners Agreements because houses with them _sell_.
@JagdwulfeThat's why you should shoot him in the ass or the leg, you know, just wound him. That way you didn't take his life. However, one day letting him live could come back to haunt you as he may seek out revenge. It may be better just to take him out of the gene pool.
Adamus... it's funny how you say our government is turning into a dictatorship and then comment that yours is telling you that you cannot own a gun... Sounds to me like your government is already a dictatorship! As far as western europe, it's so over run with Muslim extremist groups trying to run the country themselves. You mention crime rate in the U.S but fail to consider all the riots and terrorist attacks as well as plots to commit attacks that are discovered by police. Europe is no better off. The biggest difference is that if some maniac wants to come into your house at night and make you his bitch then I guess you'll just have to like it cause your not able to defend yourself.Gun control is not going to make crime go away. A better legal system is what we need here.
Most people have no idea what they are getting involved with when they buy into an HOA.All it takes is just a few fools on the board to make life in the community awful. The Lawyers and property managers can really open up the money spigot then too!It is tough to change the laws because the Community Association Institute, a lobbying organization made up of lawyers and property managers, fight any change tooth and nail...Just stay the hell away from these communities! Sell and get out, my wife and I did and couldn't be happier!@
