bits.blogs.nytimes.com — Four executives of Google begin trial Tuesday in Milan on criminal charges of defamation and privacy violation in regard to a video posted on Google’s Italian site. The case involves a three-minute cellphone video, posted in 2006 to Google Video, in which four youths in Turin tease a boy with Down syndrome.

This trial will decide who constitutes as the liable "publisher" in a scenario where content that is discriminatory, libelous or indecent is first created and then distributed. In this case the publisher is either the institution / system / infrastructure (i.e. Google) or the creators of the content. Who is liable when someone’s rights, like in this case, are infringed? My guess is (which is influenced by similar cases brought against Google) that the court will side in favor of Google. Google is not god… or more lightly… Google can not save you when break the law. PZ

Ok everyone, time to block Italy, they don't know how the internet works. "Sorry, this website is not available in your country because your government is made up of f**ktards who prosecute websites owners for things that aren't their fault. Thank you."
