Like I said, there is no Executive privileged in the Constitution. They are not immune from the law while in office. There is the opposite... the explicit means by which to try and remove these fools. I'm not sure if you didn't read my full post, or if you simply did not understand it.

This is very good news. See, if Cheney claims his office is not part of the executive, then in the case where the Department of Justice has four times appealed federal court rulings that the vice president (Dick Cheney) release energy task force records, but each time Cheney claimed he need not release those records because his office has executive privilege... well ... er.. hmmm. ummm.. Cheney can't be fish AND fowl at the same time. I mean he IS foul... but .. hemm. So he can have one or the other but not both. Meaning he's on the hook for one of the two. And maybe this is the leverage to impeach him.
