The Bush administration is very direct about their judicial appointments. They choose Judges that they believe align with the conservative "agenda".It took something for him to pass that particular litmus test, and it probably wasn't fairness.

Anyone beholden to the Bush administration would see the writing on the wall. Those "conservative values" wouldn't be tolerent of cross-dressing. It's got nothing to do with his job performance, remember the Republicans tout themselves as the the moral authority. Something tells me they would have asked him to step down.
