Everyone can be declared "an unlawful enemy combatant". Everyone! Innocent or not. US citizen or not. Without ever seeing a court. Without ever talking to a judge. And you'll have no legal defense against torture either.
It has been removed for anyone labeled as an "enemy combatant", citizen or otherwise. As Olberman explains (if you would click the damn link), without habeas corpus for people labeled as "enemy combatants", there's no way to challenge the labeling. Bush and his cronies can label anyone they want an "enemy combatant" for any reason they damn well please -- be it Osama Bin Laden, Keith Olbermann, a peaceful protester, or a random digger who does nothing but sit on his ass and complain -- and without habeas corpus for "enemy combatants", there's not a damn thing anyone can do about it.

@ chocobomogIt doesn't matter how its defined. As long as there's no habeas corpus with which to challenge it, Bush can define it however he wants.
