Some notes: 3.4 doesn't say anything about the actual open source license being used. The Android kernel is protected under GPLv2 whereas the framework Google laid on top is licensed under ASL. These are very very different. So you don't have "full" access to all of Android from a legal perspective. On 7.2, you are looking at the wrong agreement, when you distribute in the Android market you agree to the following as well from Google: http://www.android.com/us/developer-distribution-a ... Please refer to 7.2 in that document as it relates to Google Takedowns. And you can feel free to sell your app anywhere you like with Android, but most developers will use the major platforms like iTunes and the Android Market to sell them as your visibility will be the highest. They are marketing their stores so why not piggyback on it. The point isn't that Google is bad, its that people need to check themselves when it comes to just pointing at Apple. Google has a lot of hidden legalese around Android whereas Apple sticks it right out there. None of this stuff we are seeing today about Apple is new. Our lawyers have looked at it, so beware of what you are getting into.
Someone call the wahmbulance!!!God....you would think Steve Jobs came over personally and held a gun to every developer's head judging by the responses here. You guys are hilarious. I don't care if the agreement states that Apple can steal your children and sell them into slavery. They can put whatever they want into it, and if you dont like it then stop being a whiny bastard and find an alternative already.
"Just give up imanta, Digg won't flame Google, no matter what fact you bring up. They are like Glenn Beck of the internet."You want to know how I know you're a 100% brainwashed Apple fanboy?
No, "technically" they are not in breach. FOI is implied with every contract. The contract, as others have indicated, is available online before you sign up and pay for the program.
Umm... I actually hat Microsoft with a passion. I never said I hated Apple; I love them for a lot of things. I've just been disappointed with them lately. Or was that sarcasm? :L

They could make you sign a NDA before allowing you to see the developer agreement though.

What specifically do you think developers should address? If iPhone developers were to band together, what are the majors points of contention?

And still, I find that messed up. If I only made one app, and it was rejected by Apple, I wouldn't blink an eye before submitting it to Cydia.
