Cause there's so many variations on how to zoom in on a photo and what not that make sense to the user. If the patent covers that then that's still pretty stupid. What do you expect another company to do? Make a gesture for zooming in a photo down, up, left, right?

True, but I believe Google and Microsoft are both working towards multi-touch and gestures as well. So they'll have the cash reserves to fight Apple.
