I hate that it's only 3G. Like the 1st gen iphone users are going to bring down the network. I wouldn't sue them for it, but I'm not buying another iphone.

@sarchosisCorrect, but it is an included service that a subset of customers can not take advantage of, therefore it is a material in the contract that users who are paying the same amount can not take advantage of solely due to a choice by the provider of said material item.By your own admission MMS is included in the plan and the only thing that said plan states that is needed to take advantage of it is a "MMS capable device", well the iPhone has been MMS capable yet AT&T is still not providing the service thus they are withholding that service that those subscribers ARE paying for as part of their monthly contractI recommend for those that want to play armchair lawyers on the internet you at least take take a course on basic contract law at your local community college.
So they just said "Hey, there was another lawsuit against Apple/AT&T, but I don't know the details. I'll get back to you when I know something about this."
