I think what this comes down to is proper training, and doing the right thing, which Amtrak definitely didn't do. Add to that, needlessly endangering someone's life and you have the perfect lawsuit. I don't like needless lawsuits, but I dislike stupid people more... I hope Amtrak loses their shirt!
You're not too far off. A friend of mine, recently back from Iraq has had trouble getting a job with law enforcement. He's been told by county, city and state police that he's over-qualified.

Obviously the guy was incapable of making good decisions even before he went into diabetic shock--after all, he chose to ride Amtrak.
