One of the girls at her arraignment was denied bail for her actions, and the other was effectively placed on house arrest.

while this is certainly a free speech issue it's not as a cut and dry as many seem to believe. don't delude yourself into thinking that free speech doesn't have stipulations. just because we have the right to free speech doesn't mean we have the right to harass or terrorize individuals. there would be no case if the girls hadn't put a photo of two male classmates kissing in the flyer they distributed. those classmates are no doubt minors as well, and their right to privacy and to not be harassed or persecuted should be protected.your personal rights do not extend to the encroachment of the rights of others. just like you may not go around burning crosses on people's lawn and call it freedom of expression. we have the freedom of religion in the U.S. but just because your religion dictates that you may stone people for being gay or what not doesn't mean that you're not going to go to jail for doing so.

HATE CRIMES LAW only apply to VIOLENT ACTS. FAGS are NOT covered under our current Hate Crimes Law. Hate crimes based on race, religion, color and national origin are the only ones currently covered. Basically, someone could kill me for being gay and they would be punished as if they had just accidentally shot me. Now, this case deals with hate speech NOT hate crime. Hate speech is NOT punishable under the law since it is not a violent act. Otherwise, Fred Phelps, who waves "God hates fags" signs at the funerals of fallen soldiers, would have been imprisoned a long time ago. ACLU defends CIVIL LIBERTIES, which means they would be the first organization to fight for someone's right to say "God hates fags." This opinion piece does not make any sense. Either the judge is f**ked up or the author of this piece has twisted the facts of the ORIGINAL story to equate hate speech to hate crime. Why? Just trying to comment that your post was holding one group to one standard, and the other group to another. I think the "god hates fags" people should all be locked up, because I feel discrimination on that level should be illegal. That's just my opionion. But, as long as homosexuals feel the need to exercise their right to parade their sexuality (literally) down main street, blocking traffic and holding portions of the city hostage, you'll see the other side fighting equally hard to have their voices heard, in an equally public and offensive manner. Each side has their rights, regardless of what you think of their message. I just sucks when they don't agree with you.
