super6Aug 12, 2010
Not even when he asked for the second time about rickrolling?
robdiggityAug 12, 2010
Actually the 2nd was done by the defense attorney on cross.
Thing I didn't understand was was defense attorney belabored the definition of lurker so much.
kerrigoreAug 12, 2010
@robdiggity
I'm guessing these were all terms referenced on the submitted evidence documents, and the lawyers have to make sure those terms are defined so that the jurors understand them. That's why they also made him explain how an internet forum works so in-depth, explaining the whole process and what everything on each page is. Without seeing the documents it's impossible to say for sure, but I'm guessing "lurker" might have been somehow important to the documents, or come up several times. Maybe he felt the original definition wasn't clear.
letterqAug 12, 2010
Oh, come on, tell me you didn't at least crack a smile when the prosecutor asked if Rick Astley was "some kind of singer", then followed up by asking if a "rickroll" is a joke. No, it's serious f**king work. Come on!
Q. And the term "rickroll" you said it tries to
make people go to a site where they think it is going to
be one thing, but it is a video of Rick Astley, is that
right?
A. Yes.
Q. He was some kind of singer?
A. Yes.
Q. It's a joke?
A. Yes.
blklightningAug 12, 2010
agreed. i have a very broad sense of humor. but that wasn't funny.
Closed AccountAug 12, 2010
He was dead serious, accurate and straight in his testimony. Sure, a lot of it might sounds weird to grandpas in the jury who never used the Internet, but that doesn't make it funny.
jasvllAug 12, 2010
Situational irony is funny. That's why hearing a technical definition of 'rickrolling' being requested by attorneys in a court of law is humorous. "It's a joke?"
smiff2Aug 12, 2010
it's not though. it just makes the original joke seem less funny. agree with BlkLightning on this..
sagegoku666Aug 12, 2010
Q: "Rickroll"?
A. Rickroll is a mean or Internet kind of trend
that started on 4chan where users -- it basically a bait
and switch. Users link you to a video of Rick Astley
performing Never Gonna Give You Up.
I lol'd that the steno put 'mean' instead of 'meme'
malapropAug 12, 2010
It read to me like a straight forward witness statement. Thought I was the only one not really finding it funny.
jasvllAug 12, 2010
It is. It's not his answers that are funny. It's the questions themselves and the environment they're being asked in that are making people laugh.

idunavailableAug 12, 2010
Rules 1 & 2 have no meaning anymore, considering everyone on the internet knows about 4chan, as evidenced by these comments.
It's something idiots who've been on the site for only a few years can spam so they feel like they're in some secret club, even though that was ruined a long time ago. The weird part is how much people on the site, especially non-/b/ boards, despise people like the ones in these comments. Of course, all boards that aren't /b/ hate /b/ for how terrible it has been for years now. Gee, I wonder why.
/bitter nerd
jgzmanAug 18, 2010
I'm actually glad you explained that. 4chan isn't a secret, it's more like the part of town that some people don't know about, and most of the others pretend not to know about.
bluto36Aug 11, 2010

lol, he's basically giving the prosecutor a walkthrough of how to use an interactive website.
rmxzAug 11, 2010
Indeed - you could say pretty much the exact same things about Yahoo or Google groups or Flikr or Youtube. While the default might not be to directly post anonymously, one can certainly create their own yahoo&google accounts pretty much anonymously.
Though, I guess that's the point.
originalmadmattAug 12, 2010
ya.. what is up with that.. if the guy on trial allegedly hacked palins email wouldn't his "peers" already know all this?
diggmat1cAug 12, 2010
lol... the prosecutor thought "404" was a term unique to 4chan
jgzmanAug 18, 2010
Doubtful. But since the jury might be made up of the dumbest s**ts TN has to offer, it's actually better that he get this clarified.
Might also want to use smaller words.
jtotheoeAug 12, 2010
i wouldnt of known how to explain the "file upload process" the way he did. i think i wouldve just been like, "well, umm... you find the file you want and pick it." this sounds like a jury comprised of my grandmother.
mescadAug 12, 2010
You know the jury doesn't come up with the (usually stupid) questions that prosecutors ask, right? Even if every single member of the jury was a very experienced web user, rolling their eyes at the basic level of knowledge, the same questions would be asked. That's a big part of why jury duty is so boring, and why a lot of people try to get out of it.
gauthicAug 12, 2010
Yes, but if they didn't go through the terms and procedures and one Juror had absolutely no clue (yes, there are some out there!) then there would be some major issues in understanding the evidence provided. Sure it takes 15-30 minutes to describe how the website works on a day-to-day level, but I honestly think it's important.
There *ARE* people in the world who don't use the Web other than very basic casual reading of news sites--you just don't see them here.
eikaiAug 12, 2010
All those questions and yet they still wouldn't have any idea what a 'proxy' is and if it were used.
maxxusflamusAug 12, 2010
A lot of it is just covering legal bases. Prosecutor doesn't want the defendant to be able to figure out some loophole due to lack of information.
caseycooldAug 12, 2010
Lurk more! (Page 12)
headhotAug 11, 2010
Anyone else find its odd that the government had the IP and 4chan provided the activity, instead of the other way around, the government having the suspect activity, and 4chan providing the IP?
pimpwillyAug 11, 2010
Pretty sure thats how requests like that have to work, they have to track down the IP of their suspect then they get information handed over via a legal request.
The job of the prosecution isn't so much to prove that the activity took place, it's obvious it did from the logs, but rather its the defendant who was doing the activity; connecting a person to an ip address is the tricky part. "But your honor, I left my wireless network unsecured, I never am good with those computer things"
azuvectorAug 12, 2010
Not especially, if they were tracing an intrusion onto their own network/server or a place that had already provided them with the earlier information.
sexyboboAug 12, 2010
You would be surprised there was a DDOS attack on the website at the college i use to work for and while we were still trying to figure out WTF was going on we got a call from our ISP about the incident then 15 min later got a call from the FBI asking for more info about the incident.
They are fairly on the ball with this type of thing.
deathfiredAug 12, 2010
The IP of the user was of a Vtunnel Proxy (page 27 line 22) so the FBI got a search warrant for the proxy service to obtain a list of IPs for that day. Moot was then given the proxy ip list and asked to find matches on the /b/ board for that day/hour. The FBI didn't give the user's actual IP to Moot, just a list of proxy addresses. When he found a match the FBI just looked in that list to find the real IP of who was using that Proxy IP at that given time. At least that's how I understood it anyway.
bewareofthecowAug 12, 2010
In that case the guy is really stupid for using the same proxy to log into the mail account as he did to post the content on 4chan.
deathfiredAug 12, 2010
Mail account? I didn't see a mail account mentioned in the file.
saranagatiAug 12, 2010
@DeathfireD
The case is regarding sarah palins mail account getting hacked into. The FBI got a list of IP addresses that connected to the mail account from the ISP, traced that IP to a Vtunnel Proxy. The FBI knew found out that the mail was posted to 4chan, so the FBI then gave the list of ips that connected to the vtunnel proxy to 4chan and requested any logs which used those IP addresses. They reqested this so that they could figure out what IP address it was that connected to the vtunnel to "hack" into the mailbox.
@bewareofthecow
he didn't use the same proxy to connect to the mail account and 4chan. in fact he most likely didn't use any proxy at all posting to 4chan. If he had of used the same proxy to connect to both the guy would have been in a much better situation because they still wouldn't have any evidence to link the break-in to his real ip address (assuming that the 4chan connection was the only evidence).
deathfiredAug 12, 2010
Ah that mail account. I totally missed the original point of the trail haha.
xheeroAug 12, 2010
@saranagati
The person who runs the proxy service gave the real ip address that was using the proxy address. They had his real IP address just by looking at the IP used to hack the email, and then going to the proxy service provider and requesting the real IP address for said proxy address.
Closed AccountAug 12, 2010
You actually think that proxy is anonymous you f**king idiot?
bewareofthecowAug 12, 2010
The IP they mention (66.253.190.21) doesn't belong to a common ISP.
The document also mentions the use of the vtunnel proxy, which I assume to mean the web based vtunnel.com which owns the address block of 89.0.0.0/8
So I am also curious as to how the government uses a process to find a suspect without following the endpoint IP that actually posted the offending material backwards though it's routing.

A. Yes.
Q. Is that right? So there are a bunch of people I guess you can tell who view entries on 4chan, but are

I've tried to explain the hilarity of the pedobear meme to a few people I know, and I always end up coming off like a pedophile.
I'd hate trying to explain it in front of a bunch of 50-something jurors.

f**k that, I'm never posting there again.
I was under the assumption they pruned all log, but based on his testimony they keep transactions.
Not so anonymous now.Comment is buried, click here to see the rest.
oneilcoolAug 12, 2010
They said they only keep logs of there bans and deletion, which seems fair. If you post something on there and it just filters through like everything else, there will be nothing leading back to you as long as you don't get banned or your thread doesn't get deleted.
generalobviousAug 12, 2010
Yeah, I saw that part, but I don't get why they don't just turn of ALL logs.
That way when this scenario happens, they say, "Sorry, dunno what to tell ya."
It's not their responsibility to maintain logs since safe harbor explicitly states that a service (ISP, website, etc) is not responsible for the content posted by its users.
teho22Aug 12, 2010
It's kinda sad that moot's hand was pretty much forced to give up the details of poster that hacked Sarah Palin's email account, especially considering they likely got a very heavy sentence, even though email hacking goes on daily without any consequences. She ought to have known better than to use a yahoo inbox for government issues.
That being said, I imagine that 4chan would have been closed down a long time ago if it wasn't for moot's cooperation with the police and FBI. Also moot probably feels somewhat morally obligated to help bring down people are posting child pornography, claims of planning to shoot up schools or what ever. Turning off logs really isn't a sensible option.
It may surprise some of you that the site is more than just /b/, where it's just an endless stream of s**tty memes, gore and porn. It's not really worth jeopardizing the whole site for the sake of keeping /b/'s law breakers 100% anonymous.
I thought it was pretty much confirmed that moot's name is Robert Goins and not Christopher Poole. Interesting that that name was used again.
fuzzynyankoAug 12, 2010
I think it's a good idea to keep at least a limited log. You can track a user to see if he or she is doing bad things, and after a ban, you can point to the log entry and say "this was you and this is why you are banned"
darkshroudAug 12, 2010
@teho22, it's never been proven that she used her personal yahoo account for government email. That's what this moron decided to find out and now he's going to pay for it.
generalobviousAug 12, 2010
"That's what this moron decided to find out and now he's going to pay for it."
What he did wasn't illegal, though.
He just guessed her secret question's answer and reset the password. That's not against the law.
newerakbAug 12, 2010
@GeneralObvious
That doesn't fall within some realm of identity theft or fraud?
pennysboatAug 12, 2010
They said ALL the other logs are kept and then pruned. The way I understand it is that they keep logs of ALL activity including posting, viewing, downloading etc. both legal and illegal content. These logs could last for a few hours or a few weeks. Who knows.
Does not seem truly anonymous to me.

vicsvengeAug 12, 2010
This is stupid. I just wasted 10 minutes reading this horses**t.
sirfilmoreAug 12, 2010
The culture gap is evident throughout the whole report; even the court reporter isn't exempt.
"Q: 'Rickroll?'"
"A: Rickroll is a *mean* or internet kind of trend..."
^^ He obviously said meme.
joot2112Aug 12, 2010
poor clueless stenographer
darkphenoxAug 12, 2010
the stenographer also wrote mango when it was suppose to be manga the second time.
shutitdownAug 12, 2010
newfag stenographer*
sen5241Aug 12, 2010
That was a meme thing to say!
dygalAug 12, 2010
I liked the stenographer's invention of "white nights".
Closed AccountAug 12, 2010
Ya! f**k those professionals who don't sit on the internet all day looking at stupid f**king waste of time sites like 4chan. Going out in the real world, making money, having sex with girls, f**king losers!
I know people who are 18 and don't know what 4chan is because their getting straight A's in class and graduating valedictorian and getting a 75% scholarship to Harvard.
In case you don't understand what I am saying, if you know what a meme is, your probably the douche bag. Comment is buried, click here to see the rest.
tovarish22Aug 12, 2010
Psst...the word "meme" has been around MUCH, MUCH, MUCH longer than 4Chan. That the stenographer didn't know the word is a bit troubling.
kakemonstereAug 12, 2010
/s ?
joot2112Aug 12, 2010
troublemaker
putz85erAug 12, 2010
You're right but obviously you are not one of those people. You illustrate this best by not knowing the difference between you're and your.
I'm guessing from your name that your name you're probably in the military. Private First Class? What a great accomplishment you have there. You were able to not think and get told what to do in every facet of your life. Good job!
Your job is one step above Burger King employee. The only difference is your application process took longer and you get better benefits. You haven't accomplished anything by joining the military as a E3. I am pretty sure you get that just for doing ROTC in high school. So, what do you do with all your free time? Lurk on digg? Act like you're really smart and accomplished?
powderedtoastyAug 12, 2010
The word meme wasn't invented by 4Chan, it was actually invented by Richard Dawkins like 30 years ago.
theundertokerAug 12, 2010
PFC...that explains why you're such a retard.
h2ojunkie42Aug 12, 2010
Um I got good grades and scholarships to college and graduated with honors; I know what 4chan is. I also enjoy "Going out in the real world, making money, having sex with girls" as you put it.
aubieguy333Aug 12, 2010
Thank you ctrl+f for preventing me from making a redundant post. I was going to make fun of the stenographer, what with "mean" and "white night", but I was beat to it. So now I will just voice my agreement in making fun.
thejackylAug 12, 2010
That really was not that entertaining.
barasawaAug 12, 2010
It was a boring read, and I have to wonder what the lawyers were doing other than displaying their total ignorance of the subject.
(Are they going after someone for rickrolling the president or something?)
By the way, you just gotta groan when he tells the lawyer what something means, and the idiot immediately asks him what that same thing means. Is he listening, or just reading a script?
Lawyers may know the law, but there are a lot of them that are really stupid. (Like the ones that change the font and screen display size so they can see two pages of text at once, but it's too small for them to read, and they refuse to change it because they need all of it. Morons! Those are usually ones who bluster the most about "I'm a Lawyer".)
Closed AccountAug 12, 2010
It's not just about what the lawyer knows though. It's about making sure that the record is in tack for the Judge to fully install it. If I was in a case where a jpg file was involved - I would make sure someone testified as to what that meant for the court's record.
glazAug 23, 2010
Intact?
darkphenoxAug 12, 2010
I'm sure most of the jury didn't know what 4chan is.
quisphAug 12, 2010
The lawyers aren't asking these questions for their own edification. They already know the answers. They're asking these questions in order to get the answers entered into the trial record as sworn testimony. Otherwise it doesn't exist, as far as the jury is concerned.
zephyrprimeAug 12, 2010
Lawyers never ask questions they don't already know the answer to. They ask questions to educate the jury and to get the information entered into the trial record.
thekohAug 12, 2010
WOW, either I know NOTHING about law or that lawyer was one of the worst in existence.
quillAug 12, 2010
Answer: You know nothing about law.
Lawyers already know the answers to the questions they are asking.
They are looking to create a perfect step-by-step chain of events that clearly show A -> B -> C -> D therefore F. I would bet any amount of money that the threads relevant to this trial including the words and phrases "404", "new fags", "troll", and "rickrolling". These non-standard terms would need precise definition to eliminate any possible chance of confusion down the road, because it's an avenue that can be attacked by the other side.
It's so important to get right that the lawyer makes sure to get moot to specify that 404 is not specific to 4chan. Again, the lawyer already knew the answer -- it's just that he can't supply it. It has to come from the sworn testimony of a witness.
Real court proceedings are incredibly monotonous for exactly this reason.
shutitdownAug 12, 2010
I wish he would of asked Moot to explain rule 34. haha
alexbarnes94Aug 12, 2010
That would have been amazing.
rytheguy88Aug 12, 2010

I assume you mean the blog-article. Yeah. I skipped the article and just read the PDF, which was somewhat amusing. This court asking questions about internet memes and jargon (one of the most silly and inane things in existence IMO)

A past tense and a past participle of spell1
