Porn outfit Hard Drive productions had demanded $3,400 to make their threatened lawsuit go away but their target not only says she's innocent and harassed, but also that porn cannot be copyrighted. So, does filmed sex promote scientific progress or constitute useful art? A court may soon have to decide.

I doubt they really believe that it can't be copyrighted, and doubt they could win on those grounds, but threatening to push the issue in court might be an interesting way to get the plaintiff to back away from a risk.

Porn isn't the only thing that isn't science and the useful arts. Everything Hollywood and the recording industry produce is just frivolous entertainment, which should get no copyright protection. Entertainment is worth what an audience decides it is worth, no more. If that is nothing at all, tough! Entertainers can always get a real job.

It's also interesting that the constitution only protects writings and inventions, I did not know that. It's obviously already a stretch to extend protection to sound and image recordings.

It's the irony that the most fascinating aspect of this I think. Outfits like Hard Drive and their lawyer bottom feeders essentially coerce their victims into paying them a lesser amount rather than risk a far larger amount by going to court. But in this case they are the ones taking a huge risk by going to court. If they lose and porn is determined to be not copyrightable then their whole little extortion scheme is kaput....and they all might have to actually start looking for honest work somewhere.
