My studio has a copyright on a script where a Digg user sues another for giving away the plot of a movie. Expect a subpoena in the mail any day buddy...

I know they can get pretty uptight if you release the review a day earlier. Television exec are the only ones I've seen specifically tell reviewers what plot points not to mention in reviews, though.

Every article I've seen about this has been a sob story (poor struggling flower seller? send paypal donations here? come on..)

The private investigators probably obtained evidence/information without her permission. Further, there are no rules about excluding illegally obtained evidence from a civil suit.
While a civilian may face criminal prosecution for breaking into someone's home, any evidence obtained by doing so remains admissible, certainly in a civil case, and probably even in a criminal case. Cops can't be prosecuted, but the evidence (should) be excluded if obtained without a warrant.

The theory there is that you choose to fly and you agree to suspend your rights in order to have the privelige of flying. I don't necessarily agree, but that's their legal basis.

How is re-posting something found all over the web the same as publishing *secret* formulas? And since (all but one) of these scripts was widely available, for free, she may well have not realized that it was wrong. Actually, even that one script was widely available, despite being unreleased; it's not like she broke into a vault to get it.

I feel for her, I really do, and $12 million is outrageous, but what did she expect to happen? You can't just post someones copyrighted material anywhere you want, even if its freely available from a variety of other websites. I'm always of two minds about these issues. If the tables were turned and Fox reposted this lady's screenplay work, we'd all be on HER side and she'd sue for all she could.
What I see here is a writer who couldn't make it big, so she found alternative shady means. As a writer she knows it would suck to have your copyrighted work reposted, decreasing its value. She was out to make money (and/or connections) off other people's work here.

It's not uncommon at all for sites to post screenplays. Many books (even top recommended books in the industry) will often recommend sites to read screenplays. In fact, the WGA (west, not sure about east) site actually links to sites that have screenplays to read.
I guess the big issue here was the posting of the Deadpool script. I doubt they really care about the rest. It mentions she uploaded it a second time, which was stupid on her part. But it also makes note that they never contacted her. A simple cease and desist would have been just fine. So in conclusion, both parties are pretty dumb.
As for the mention about is it any different than posting novels. Major difference. Most screenplays you read, even final versions are vastly different than their film counterpart. That and it's just a small part of a much bigger picture. As opposed to a novel where the writing is the whole thing. But the point is valid about posting an unreleased novel.

I'll bet they are projected to spend more than 12 million on the making of the Deadpool film. I'll bet that if we boycott the film they'll lose more than 12 million.
I can't speak for all of us but I myself will not see that movie if they continue this action against her. Cease and Desist makes more sense. I don't always agree when a C&D angrygram is sent, but it is understandable. THIS is just going too far. Keep it up and I think it could be costly for Fox too, the long run.
