The Lodsys developers ought to be shot and buried in shallow graves so animals will eat them.
As far as I'm concerned, unless THEY go out of their way to make it known they hold a patent BEFORE a developer uses technology they supposedly developed (which they didn't since their patent is generic enough to hold a copyright on a s**t compactor), then they can't suddenly claim they hold a patent.
It's unreasonable and unrealistic to expect any new start up to scan through all of the millions of patents out there to see if they might infringe upon something before they create their product. It is also unreasonable and unrealistic for a company to have to pay royalties on a patent they didn't even know existed until after they developed their product. Had they known it existed, they would have developed their product differently.
As far as I'm concerned, if you want to sit on patent which you are not actively making use of in the public space, then the burden is on YOU to actively seek developers to make sure they are aware of your patent before they potentially use it. Else, well, go f**k yourself.
Anyway, good for Apple for backing up their developers they depend on.
