I implore all of you to watch Kevin Smith's first "An Evening With..." for an awesome and entertaining take on Prince's ***** that even beats out Charlie Murphy's experience. He seems like the kind of person who doesn't give a ***** about another human being but himself.

A performance manifests in a different copyright than the song; while Yorke has the copyright on the music, Prince has a performance copyright on this particular rendition. The recording of the performance in a fixed medium (ie. camcorder) by the audience is probably a violation of Prince's copyright. Yorke has just given free license to his music in this instance when he told them to go ahead and publish it. One also has to ask how much of a transformation the music has been through when comparing it to the original song, and what amount of it is left.

Stoggoth is absolutely correct... there can be multiple copyrights in a song. The person who wrote the song can have a copyright in the music composition and lyrics, the band that first records it can have a copyright in their particular sound recording, and someone else who performs it publicly can have a copyright in the video of that performance. I.e., there isn't a single "one size fits all" copyright in the song.
There are interesting questions about whether Prince actually does have a copyright concerning his public performance, when that video was recorded by someone else. Remember the OK Computer reviews in some of the US press that said 'there's no creep on here'. Radiohead is just one of those bands that's different per-album; their sound changes as they change - and that's a good thing. NIN is the same way, same with Weezer.
Thom didn't like the effect 'Creep' had on the US market because it was kinda samey to the genre we had at the time; it was Yet Another Alternative Song, despite its being awesome. I guess he thought, rightly, that Americans would see their future works as not up to par - that's where the music review idiots came in and verified his fears.
All in all, though, it hasn't harmed Radiohead as much as anyone thinks in the US.
