- ALLCAPS, on 10/12/2007, -3/+186The RIAA's probably claiming they whistled the songs to each other.....
- UGM2099, on 10/12/2007, -1/+158Well they WOULD steal music if they had a computer, this is just a preemptive strike.
- Reliant, on 10/12/2007, -2/+149If I were that family I would try to countersue saying that the charges were unjustified. I hope that there is a decent judge over there that would throw this case out. RIAA needs to be stopped!
- Cjattwood, on 10/12/2007, -1/+121The RIAA are completely out of control.
- ai42, on 10/12/2007, -8/+97The RIAA is the real terrorist.
- ThomasCJohnson, on 10/12/2007, -2/+75oh *****
- BooostedAWD, on 10/12/2007, -1/+72It certainly seems like they just tear up a random phone book and draw the names out of a hat.
- AeroSquid, on 10/12/2007, -1/+65someone should sue the RIAA for harassment
- r00tus3r, on 10/12/2007, -1/+63I'm going to make one request. Could someone, anyone, clearly and concisely explain to me how the RIAA obtains it's evidence and determines who to prosecute?
- ThomasCJohnson, on 10/12/2007, -6/+64We are very greedy in the US, and we want money in the easiest way possible.
- SoulMaster2, on 10/12/2007, -3/+56As I recall this isn't the first time they've sued someone without a computer
- inactive, on 10/12/2007, -0/+52do these ***** randomly pick people from a list or something?? spin the wheel??
ok...today we are sueing........THE JOHNSONS!!!1 - deadbaby, on 10/12/2007, -5/+53Don't hold your breath... The US government is bought and paid for by big companies.
- mwace, on 10/12/2007, -1/+49I specificly recall the RIAA suing a elderly women who had never used a compter in her life before, and I don't even follow these atriocities. The RIAA is continually filing lawsuits arbirarily and without evidence and bullying there way into thousands of dollars of damage fees, without regard for respect for the people they're attacking. For example, the MIT student who was given the advice that "maybe he should drop out of college" in order to pay off the RIAA.
- lanaiguy, on 10/12/2007, -0/+44Makes me wonder at what point a judge will throw out all a plaintiff's court filings due to the plaintiff's arbitrary and abusive use of its privilege to see civil redress of grievances?
- zoomie, on 10/12/2007, -2/+44Too many lawyers
- jonathanex, on 10/12/2007, -0/+40So, they've tried to sue 8 year olds, dead people and people without a computer. This is beyond a joke.
- skatingrox, on 10/12/2007, -2/+41RIAA Lawyers are merely skilled liars, hired to squeeze money out of innocent consumers.
- fantasticFlan, on 10/12/2007, -2/+37"I'm not defending their methods, but they have every right to protect their clients' work."
They don't have every right, they don't have the right to terrorize the public. - plnegative1, on 10/12/2007, -15/+49Music is the language of the world. It should be free anyway.
- DDRSkata, on 10/12/2007, -0/+32That's a brilliant idea. Someone should start a class action lawsuit for all those who have been sued by the RIAA so far, especially those without computers or internet access and those affected by the "RIAA Police" scheme last year.
- toxicredm, on 10/12/2007, -1/+30When is someone going to bust this monopoly like others in the past?
- pixelmatrix, on 10/12/2007, -2/+31the RIAA is just like a modern day McCarthy. Pretty soon someone will have to stop this witch hunt.
- handshakedrugs, on 10/12/2007, -1/+28"However, the RIAA’s lawsuit maintains that Carma Walls, through the use of a file-sharing program, has infringed on the copyrights for the following songs: “Who Will Save Your Soul,” Jewel; “Far Behind,” Candlebox; “Still the Same,” Bob Seger; “I Won’t Forget You,” Poison; “Open Arms,” Journey; “Unpretty,” TLC; No Scrubs,” TLC; and “Saving All My Love for You,” Whitney Houston."
I really want to say something pretentious about the selection of songs this person downloaded. Must...resist... - p9s50W5k4GUD2c6, on 10/12/2007, -0/+27While I hate to see more people get hurt, I hope to see more of these secret RIAA bully tactics posted on DIGG.
I just saw another one where a 15 year old girl was driven into a depression due to the litigation of the Record Industry.
I ~hope~ critical mass continues to build against the RIAA (in every way).
The RIAA needs to be CRUSHED. - affanjam, on 10/12/2007, -7/+33Why couldn't Osama Bin Laden attacked the RIAA Headquarters?
- ZenPirate, on 10/12/2007, -0/+26Useless fact:
The USA has more lawyers per capita than any other country in the world. - handshakedrugs, on 10/12/2007, -1/+26Then you must not realize that there are millions of people out there that can barely afford food, let alone a computer. And I'm merely talking about the U.S.
- splammo, on 10/12/2007, -1/+24Terrorist: a radical who employs terror as a political weapon; usually organizes with other terrorists in small cells; often uses religion as a cover for terrorist activities
I would say the RIAA isnt the only orginization in america that fits part or all of that description... - inactive, on 10/12/2007, -4/+26And here's your free internet coupon.
- durex, on 10/12/2007, -0/+223rd completely outlandish case on these guys in like 4 days now? This is really starting to get quite ***** disgusting.
- p9s50W5k4GUD2c6, on 10/12/2007, -1/+23LOL. ThomasCJohnson - get rid of your computer!
- gxti, on 10/12/2007, -1/+23It's not just sad that these things happen, it's even sadder that it's becoming commonplace!
- rawheadrex, on 10/12/2007, -0/+21"However, in a public statement defending the litigation, the RIAA says its efforts have been effective in dissuading illegal activity"
Therefore, not only are the RIAA not denying that they use a scare tactic, but basically they're saying how well their scare tactic works. What a bunch of smelly orifices. - gxti, on 10/12/2007, -1/+22Not by sueing anyone who looks at them funny. It's silly, it costs people money, and it's getting nothing accomplished!
- Mesach, on 10/12/2007, -2/+22Anyone ever think that they might be the victim of Identity Theft and that the culprit used thier identity to sign up for an ISP.
or does the RIAA know it came from that street address. - Nameless1, on 10/12/2007, -5/+23Becouse the U.S. is run by capitalist bastards.
Where as in my country we dont have this sort of stuff since its run by corrupt polititians and other garbage.
Anyway everyone should just countersue the RIAA. See how they deal with 3000 or so lawsuits. - kyriakos, on 10/12/2007, -5/+23why these things only happen in the US? :P
- DDRSkata, on 10/12/2007, -1/+19http://pics.livejournal.com/netter/pic/000134ea
- ThomasCJohnson, on 10/12/2007, -1/+18I wish I could remember the legal term that refers to a civil case that is meant to prevent a tort.
- signal15, on 10/12/2007, -0/+17Keep in mind they are tying up the courts, which is costing your tax dollars. So, everyone ends up paying for this.
Maybe if everyone went down to their local courthouse and sued RIAA for price fixing (which they were just convicted of), it would stop this behavior. In Minnesota, it's $55 to file in concilliation (small claims) court, and you can tack on those fees to whatever the amount is you are suing for. The max amount you can sue for is $7500.
So, just look at the class action settlement (which I was not a part of), figure out how many cd's you bought and what they owe you, and then go file the paperwork. If they don't show up, they lose automatically and get a judgement against them. Otherwise, they've gotta pay someone to show up in court, either an employee of theirs, or a lawyer acting on their behalf. Both of which is going to cost way more than it's worth. So, they will either end up offering a settlement out of court, or losing by a default judgement for not showing up. It doesn't make sense for them to fight it.
But, because they were convicted of price fixing awhile back, you are not bringing a frivolous lawsuit against them, so there's really no way they could countersue. They could certainly try to have it thrown out, but that would require paying someone to show up for them. When faced with hundreds or thousands of these cases, how do you think they are going to react? Basically, this would be a taste of their own medicine, but it would actually have merit if you've purchased any CD's.
Someone should set up a project website for this, and provide links to forms for each state, and filing info. It's REALLY easy to file once you know what the steps are. - Akyan, on 10/12/2007, -0/+17I can't believe someone would abuse there kids name like that, pretty perverse.
- Akyan, on 10/12/2007, -4/+20Why does this not exactly suprise me.
- UNL1M1T3D, on 10/12/2007, -0/+16The RIAA has only been able to deter a small amount. As a matter of fact though I believe I read an article on digg that actually said Peer to Peer usage is up. It's not just the "hardcore" P2P crowd anymore. I work at Kmart and when I sell MP3 players, a lot of times I get asked "where can I get music to put on it" and so I go and tell them about Napster and Itunes, but most of the times they ask me to recommend a free service. I have actually had mothers with their children standing right next to them asking me about Limewire and other P2P apps.
- fantasticFlan, on 10/12/2007, -3/+19RIAA = Recording Industry Ass. of AMERICA
- DocDEB, on 10/12/2007, -0/+16"Well they WOULD steal music if they had a computer, this is just a preemptive strike."
Ahhhh... the RIAA's Department of Pre-Crime. That's where old rock stars go... they become the prescients floating in the tank. - ChewyBass, on 10/12/2007, -2/+18I shall forsee the future if this continues.
Latest headline "RIAA sue girl for illegal file sharing"
Tampa resident Anita Lyric is being sued by the RIAA for illegally sharing songs while sitting at a traffice light and having her stereo turned up loud. The RIAA responds that this blantant sharing of music is no different that sharing files through a computer. We estimate that Ms. Lyric may have shared as many as a thousands songs with millions of people in the course of her driving around town. In the best interest of our artist, we feel that the automotice industry should remove all stereos as once. If we lose in our attempts we shall seek an injunction to have all ears remove from mankind in order to protect our profits. - UNL1M1T3D, on 10/12/2007, -1/+15Who's next Jesus? "Jesus is being charged with illegally downloading 'hit me baby one more time', your honor" The RIAA is a joke.
- jasqwerty, on 10/12/2007, -7/+21Yah, I've said this before and I'll say it again. You can't counter-sue the RIAA for anything when this happens. They didn't magically somehow finger you. From their end, all the data is legit, and court proceedings are fine. If you don't even have a computer, sue whatever ISP fingered you as a paying, and infringing, customer. And RocketMike, you might have a dynamic IP, but dont' for a second think your ISP doesn't track what IP is assigned to you and when.
- adolfojp, on 10/12/2007, -12/+26Of course it should be free. After all, not only does it cost nothing to make music, but artists don't need to feed their families either.
