We are the attorneys for the defendant Marie Linder. We respectfully request a pre-motion conference in order to make a summary judgment motion dismissing the complaint, and for attorneys fees under the Copyright Act. Ms. Linder is a home health aide who not only never "downloaded, distributed, or made available for distribution" any files, but has never purchased, used, or even turned on, a computer, in her life. Thank you.

It's more likely that they are ashamed of their mistakes and are acting unapologetic.
I'm sure some people in the grave and who have been dead since long before the
internet was created are receiving their papers from the RIAA right now.
We need an application that tells people what to listen to (dumb people are paying
the RIAA for this very service) but directs them to independent/non-RIAA music
with a better level of service and convenience.

You CLEARLY don't know what you're talking about. Believe it or not, there are still plenty of folks out there who don't have a computer, and if they're older, chances are they've never used one either. I know several in my own damn family and I'm a nerd who gets paid to work on computers, so I know good and well there are still a lot of others in this town who don't have one. A computer is not a necesity of life to everyone.

The same justification can be used for tapping phones without a warrant. "So we trample a few freedoms, big deal." Hopefully if more and more of these "oops" lawsuits are brought to the public's attention, we can end this silly process and scale back the DMCA to, oh I don't know, allow the free market to decide what industry succeeds or not. We're seeing signs of record labels turning on the RIAA and even some lawmakers (Sinunu) are starting to question the tactics of the RIAA and MPAA...anything to give a black eye to these gangsters is OK in book... - ever, on 10/12/2007, -0/+0dugg.

Do you realize that the RIAA and others file John Doe subpoenas to the IP's ISP, and then they cough up the info. Why don't any of you, or even the people getting sued, ever sue or complain about how exactly they were fingered by an ISP since if they never even had a computer, I'm doubting they ever had a business relationship with an ISP.

Like a MAXIMUM number of lawsuits an entity can file per year, because this crap the RIAA is pulling is *****, or a set limit on the amount of money that can be used for cases. I don’t know, it just seems people should have the right to a FAIR trial.
The RIAA has the money to push the judgment their way in pretty much ANY case, and they don't care about who they sue.
What I want to see is the RIAA sue a Recording artist that downloaded & shared another artist's music.
Doubt we'll see that anytime soon though. We'll probably see it when "Recording Artists Fly".

There is not one thing in the suit filing that positively ties that woman to the kazaa account for which they provided screenshots. This is nothing more than the RIAA trying to overwhelm and intimidate average people with confusing legal motions that they have little defense against due to minimal financial means. Where's the ACLU when you need them? Wait, please don't answer than one...

See a copy of the complaint at: http://www.eisinger.net/law/RIAA_v_Lindor.pdf (3.1 MB). While it might not be hers, it has her last name in it and the RIAA obviously tied it to her somehow -- in theory with some evidence if they were able to file the suit.
