From the cd to their iPod, which would fall squarely under "fair use" by any less-than-retarded interpretation. Not the same as what you guys are thinking, where you just pirated it and then copied it to your iPod.

They expressed their support for *buying* music online, not sharing it.
As for encouraging users to pirate their music - they said to point your browsers to Limewire "soon", the same Limewire who've announced they'll be selling music online "soon".

It would be very unusual for Franz to own their own masters, in which case, technically, the RIAA could take action against them for doing something that hurts exploitation of the masters. However, that is extremely unlikely given that it's a cover song. Kind of clever of them to encourage downloading on a cover, where the revenue stream is already impacted by royalties to the original artist.

Overkill? - smackhero, on 10/10/2007, -0/+2bowie allowed people to remix his songs without paying royalties and even provided the raw tracks on his site and held an online contest, so he may not ask for a lot of royalties from franz ferdinand. and even if he does, that's not the point. you guys act like just because it's a cover that franz ferdinand isn't make tons of money off of it. royalties are just a percentage. they're still going to make at least a few hundred grand off of that one song alone.

- pen25, on 10/10/2007, -0/+2was listening to npr the other day. was talking about bands going back on the road because there they can make more money. they do not need the album to support the concert or the concert to support the album. bowie was one of the artists who was talking about this.. they know that if they go back on the road its almost pure proffit for them. they dont need huge stadium venues any more. and who in thier right mind wouldnt want to book bowie the who the eagles without lable support? i love it. and as far as the lable crap. i stopped buying long ago. ill buy local support local. but wont buy major lables unless i love the band then ill buy used and then ill email the artist to sell thier stuff online on thier own distribution channels and id have bought from them and if they swing around on tour ill check em out but i wont pay the lables so the artist dont get squat.
