The MAFIAA will have to effectively shoot themselves in the foot they have to admit that what they are after isn't the "IP thief" but the "guys who aren't giving us their money", for one - a PR nightmare. Also, the site will argue that resale is legal. MAFIAA will have to argue that it isn't resale, and how can they do that? By actually admitting how digital copies work. Furthermore, suing the site will be like suing eBay. Doesn't make much sense.

But I'm willing to bet that the true aim is to create a music-sharing website that might be difficult to shut down due to peoples right to on-sell legally purchased music.
Expect people to sell albums for 1c, and others to buy them as a convinient and "clean" source of music. And the site itself skims a little off the top for sales.

- ricamac, on 12/04/2008, -1/+23As long as membership to the site requires you to sign a statement swearing that all files offered for sale were legally purchased by you, and that you have (or will) erase all copies in your possession when the sale goes through, then it falls back on you, not the site. So unless the bad guys start getting subpoenas to look at the hard drives of users, and find cheaters, they can't sue anybody. (But they'll probably do that, so it boils down to the same thing as a pawn shop dealing in stolen merchandise. Do pawn shops require users to sign affidavits stating that merchandise offered has not been stolen? I never used one. Anybody know?)

- cesclaveria, on 12/04/2008, -0/+19I guess his point is that for the RIAA's lawsuit to work they will need to clearly define and explain how a digital file works and how the people selling the mp3 is still keeping the file, so, they will have to invalidate some of the points they have been making about how digital sharing is like stealing.

- DamnMan, on 12/04/2008, -0/+16It depends on how well these MP3 EULAs hold up in court (based on how well other EULAs fair, not well) and whether "Non-transferable" licenses are enforceable or even if MP3s are Licensed or Sold. Its not as clean cut as the RIAA's legal eagles want everyone to think.
