No-one has yet been sued twice. Now that he has paid up he should only use free downloads until he has gotten his money's worth back. Perhaps he should use an anonymous IP layer, just to be sure he doesn't get caught. In this case I think it is morally OK since he *has* paid for it already.

Can't afford a lawyer? Call the EFF and ask for help. Submit a story to slashdot and digg and boingboing and set up a page to help you fund a legal defence.
No judge is going to give the RIAA $100,000 in damages because you left a wireless router open.

demanding commission then for the thousands of cd's I've sold for them.
I'd probably also use the excuse that I was downloading music in order

What ever happened to innocent until proven guilty (although I'm not sure that exact phrase would apply in civil court)? I hope they sue someone that has nothing to lose someday.

You are making a false assumption. The RIAA can keep a person tied up in court until the end of time or until the person being sued runs out of money. This is why the settlement money is usually set the way it is. It's just high enough so that it makes it worth going after someone but it's low enough so that a person can see paying the settlement as a viable alternative to bankruptcy.
curtlow, you make it sound like just having huge balls is enough to stand up to the RIAA. It's certainly a start but massive testicles alone ain't gonna to squat in the court room. Have pockets that are as deep as the RIAA well of cash is a bigger advantage. But how many of us can make that claim?
