Shouldn't there be a difference between posting an actual copywritten work such as an SNL clip, and posting an amateur video of a 5 year old retelling his favorite story?

- alricsca, on 07/20/2008, -0/+10The trap for them is that if they win then they have basically said that whether a person's action in posting a content is a copyright violation or fair use is based on the poster's state of mind when they posted the content and if they lose then they will have to examine every posted bit of material and make a determination about its fair use merits. Notice they are trapped from trying to argue the existence of fair use here because it is so obvious. To do so in this case it would produce public outrage and risk an even more damaging precedent when they lose.

When schools put videos of class room seminars on line globally where some copyrighted material is displayed or used, is that not supposed to be fair use? South Park, for example, uses parody and public commentary that uses persons' names and their personas and has even gone so far as to describe and comment on the the big alien cult secret of Scientology. Last I checked it was globally televised. Is that not a fair use based right to you? Are you saying it is okay for the media company's to use other peoples work but not a mom? For that matter, without fair use one could not legally quote a person. If something is fair use, how distributed it is should not matter.
You are letting a example of popular media being posed to cloud you to the ramifications of your mode of thinking. What if this where not a video of a baby dancing to a bit of a popular song but a major news event like a shooting at a dance where Prince happen to be playing in the background. Unless they can make show youtube was somehow paying her they are pissing in the wind. The person who actually made the video does not stand to make anything from it. That means if I wear Nike shows and post a video to You Tube. Nike can claim copyright infrigment and have it removed. There is a BIG difference of posting a clear copyrighted clip of Prince, (A music video) or fair use, Prince playing on the radio in the background.
