polishlinux.org — Nine people involved in a community portal napisy.org were arrested in Poland accused of illegal translating of foreign movies. The website (already shut down) was located on German servers. According to Polish copyright law any “processing” of others’ content including translating is prohibited without permission.

- michuk, on 10/11/2007, -0/+5Update to the article: it turned out (clarified by the police just now) that the people have not been really arrested but only held for questioning for 2 days (yesterday and today) and then allowed to leave for the time being. The article have been updated, but the title on Digg cannot.

Police officers from four states, cooperating with German Police, took down today a Polish subtitle sharing website napisy.org. Nine suspects were arrested, including translators and website administrator. Police secured hardware, pirated software and 2000 Cd's with pirated movie material.
The arrest would not be possible without help from German police. It is Germany where the website was hosted. Suspects are awaiting charges. They could be sentenced up to 2 years in prison. Polish law forbids translation of copyrighted material without copyright owner permission. Suspects did not obtain such permission.
Raid was coordinated by Polish National Police Headquarters with support of Fundacja Ochrony Tworczosci Audiowizualnej(Protection of Audiovisual Property Foundation)

Wykop of the day and few news articles accross the web left me stunned today. Police scored another "points". We used to laugh, but recent actions in Koszalin Dormitory (Academic network took down by police) and closing down subtitle sharing websites(only napisy.org was actually disabled by police action, but other sites suddenly started having problems with databases and servers, for example napisy24.pl announced that they are going underground from now on) scare me. And it happens here in Poland where the law is nowhere near as restrictive as DMCA.
Why is it happening? Is it the government which wants to show-off how civilised country it is and how good we are fighting piracy. I don't think anybody believes that any action like this executed by police is going to cut down illegal sharing. It just means that the whole thing will go underground.

Worst part of whole situation is that Polish copyright law does not say you can't translate a copyrighted material(as stated in police official information) but it says that you cannot redistribute it and make profit of it, which was not the case in napisy.org functional model. It was all free and translated by volunteers.- fuutott, on 10/11/2007, -0/+2In E-mail from one of the admins of napisy.org he writes:

Police misinformed public opinion. There was only 6 people held. Three administrators, two moderators, and a female translator. He doesn't say what will the future be for napisy.org website, and is currently seeking lawyer help. He demented information about 2000 pirated CD's, and pirated software installed on admins/mods/translators hardware. - michuk, on 10/11/2007, -0/+2"In E-mail from one of the admins of napisy.org he writes:"
The article has been updated with the comments from the napisy.org service administrator. - fuutott, on 10/11/2007, -0/+2Whoops word demented wasn't supposed to be there. It was supposed to be: "He denied existence of alleged 2000 pirated CD's" he basically said that the police lied.
Za duzo kawy, za duzo kawy... ;)

- acm79, on 10/11/2007, -0/+0why subtitles are guilty?!? what the heck?!?
- harad, on 10/11/2007, -0/+1Polish law says that the mere act of distributing the subtitles without being allowed by the legal owner of the movie is a crime. But you are allowed to do the translation for own needs.
- dpc5, on 10/11/2007, -0/+2Madness.
- koniczynek, on 10/11/2007, -0/+1Madness?! This... is... Poland!!!
- michuk, on 10/11/2007, -0/+2"Madness?! This... is... Poland!!!"
Well I don't think it's Poland-specific. In the US there just isn't a market for such a service since most of the movies are in English anyway... And the law in most of the coutries prohibits publishiing own translations. The exception is Sweden I believe (but there may be more).
- ravbaker, on 10/11/2007, -1/+0@mendaxpl It's a brilliant idea!
- michuk, on 10/11/2007, -0/+1"Warning: The Content in this Article May be Inaccurate

What the heck? What is inaccurate in the story?- JanWinnicki, on 10/11/2007, -0/+1don't know.strange :/
- michuk, on 10/11/2007, -0/+2OK I re-submitted the news story here: http://digg.com/movies/Poland_9_People_Held_by_Police_for_Translating_Movies
I removed the inaccuracies in the title (explained here: http://digg.com/movies/Poland_9_People_Arrested_for_Translating_Movies#c6732537). Hope it won't be marked as inaccurate this time, since it has been already confirmed by major Polish newspapers and some English blogs on the net. - orzi, on 10/11/2007, -0/+1Maybe this refers to the Email sent by one of the admins of napisy.org where he writes: "I personally know of 6 persons (not 9 as the police claims): 2 admins, 3 moderators and one translator (a woman)." and "Also, I don’t know anything about those 2000 CDs.".
However, this information is included in the article, so it should not be marked as "inaccurate".
- man0wce, on 10/11/2007, -0/+1how the hell makin' subtitles can make movies makers lose millions of dollars? please, explain, 'cause i don't understand. mind you that translators do their job *for money* while those guys where spendin' their time to translate somethin' *for free* and not only for themselves, but more - for *everyone*. is it a crime?!
- michuk, on 10/11/2007, -0/+1Yep, certainly looks so. At least in Poland...
- antonioroog, on 10/11/2007, -0/+1One of the oldest polish subtitles service offering napisy do filmów http://www.napistrefa.px.pl still exists but download is blocked...
