MPAA’s Hacking Past Comes Back to Hunt

torrentfreak.com — The MPAA isn’t known for wasting opportunities to obtain information about BitTorrent sites and their users. In 2005 the MPAA paid around $15,000 to a hacker who obtained emails from TorrentSpy and The Pirate Bay. The case was heard in court and won by the MPAA, but this decision will soon be appealed.

That should have not only been thrown out of court but both the person bringing the suit and the "hacker" who reconfigured the mail server as he did should be arrested. What they did is not only invasion of privacy but also theft as well. They were stealing all the email not just emails related to the case but EVERYTHING. It amazes me that the RIAA can get away with this then keep it tied up in court so that they don't get *****.

    So just to get this straight.. the MPAA can blatantly break criminal law and get off scott free but if you infringe copyright.. which is not a criminal crime (like hacking) you must go to jail.. and they wonder why people pirate.. just another example of bourgeois oppression.

    Sounds like a failure of the TorrentSpy lawyer to pick a better/applicable argument. I am sure their is existing laws against buying information you know was gained through a criminal act.

    from the sound of the article the guy already had access to the mail server because he was an "associate" of the torrentspy guy...

  • ivanalbright, on 04/13/2009, -2/+1Sounds like the hacker is the one TorrentSpy should have sued first, not the MPAA. Once the courts determined the information was stolen, TorrentSpy could then go after the MPAA for purchasing stolen information or hiring someone to perform a criminal act.
