2. At no point does anyone refer to Dent as dead
3. Out of respect you don't turn the head of a dead person
4. He will fill the void of leading the mob, just like in the comics
5. The Joker's ace in the hole is a legacy that sets the momentum of the third act; we had themes of fear (Begins), escalation (TDK) and will most likely end with the theme introduced at the end of the movie ... sufferance

Chris Nolan has gone on the record and expressed disinterest in using Penguin or Catwoman in the next Batman film because it would be "too obvious".
