He never does anything without a script in hand, and to get one, he'd have to go through David Goyer and his brother (who is busy with T4 right now). Second, I'm willing to bet that he wants to do another project before he starts with a new Batman film, like he did between Batman Begins and The Dark Knight with The Prestige. Third, this is a Warner Bros. executive saying this to Michael Caine. Of course a Warner Bros. executive wants some big name actors in the sequel to the company's biggest film. Fourth, Goyer and Jonathan Nolan both did talk about how they're not really interested in villains that people expect, like the Riddler, and Christopher Nolan said himself that the Penguin wouldn't work in the Nolanverse. All in all, these are simply the words of an excited Warner Bros. executive who doesn't know ***** and is just spreading false rumors. And thank God for it, I'd never want Depp to play a part in the Batman film. Nolan does a great job picking actors that you just wouldn't expect, and Depp is just too... typical, one dimensional, and A-list, all of which are things Nolan looks away from when casting.

Johnny Depp as the Riddler will be quite entertaining, he's a good actor, I just hope it doesn't get too cheesy.

Although if they cast it well and change The Penguins backstory a little bit, it might just work. Although I don't think I want to see Depp in a green jumpsuit anytime soon

What's great is that when Nolan starts work he usually works quite fast considering the quality of his work to date.

A lot of people also like this new direction as it is showing that the stories and characters are far more serious and deserve to be respected. As for Depp not standing for it ... A) he doesn't have much of a choice if he signs on. B) Sweeny Todd anyone?
