With that said, what a horrible problem this is. Frankly, Fox owns the rights to release. They purchased the rights to the movie, and exercised those rights by sitting on them for 20 years. They should be flogged for that, but they DID purchase the rights. Knowing that, WB still made the movie.
Shame on WB for not ironing out this problem years ago. Shame on Fox for simply waiting to see if there would be any buzz or a potential smash hit before taking any legal action. I know they contact WB before, but if they were that pissed about it they should have taken legal action years ago.
In the end it's a simple case of rights, and Fox owns them. If it is ruled otherwise, then shame on the legal system. I'm not defending Fox, as I think it's obvious they want to make ***** of money for doing nothing. But this is what is legal.
Also in the end, it's the fans that may potentially pay for all of this by either not getting a movie or getting a hacked version of one.
On a separate note, is there legal precedent for a company forfeiting the rights by not protecting them? Like in copyright? - SifuMoKung, on 01/09/2009, -2/+22As a result of this lawsuit, I decided not to buy any seasons of House, and I will intentionally acquire them by other means. I will not buy anything that profits FOX. In fact, anything I can do to to decrease their revenue is now my artistic responsibility. If a court decides that they are entitled to the profit share of this film, they should be required to compensate Warner Bros. for their investment, as well as any other contributing parties. This is greed for greed's sake, and it is reprehensible.

WB also paid for rights but went out on a limb and made the movie. Forget about who's rights came first. Make WB reinburse Fox for whatever they paid for the rights and close the case.

- MisterFurious, on 01/09/2009, -0/+11I know Lloyd. He's a great guy, and a true comic book fan. He devours the latest titles from his local comic book shop every week. Great job, huh? Being a successful film producer AND being able to read all the comic books you want?
Unfortunately, basic issues of right and wrong are usually not what a court decides. Instead it's legal principles that, right or wrong, are the law, and up to the courts to interpret. If Fox does indeed have a right to a piece of the "Watchmen" juggernaut, whether they passed on it originally or not, it's in their statutory and financial interest to pursue it as far as the courts will allow. Alas, if someone at Warners' legal team screwed up and didn't check to make sure ALL rights were acquired when they committed to the project, then it's their fault, and an extremely costly one (lots of heads have probably already rolled under that iconic water tower).
Were it up to me (and it isn't), if Fox really did have rights to the film, then I would at least decree that Warner Brothers is entitled to recoup their investment in the film, including interest. That way, Warner Brothers can use the creative accounting that studios are famous for and make the film appear "unprofitable" on paper, so Fox never sees a dime (remember "Batman"?)! If Fox didn't have rights, then I would file a brief calling them douchebags and asking them to not let the door hit them on the way out (needless to say, with language like that, my career as a judge would be a short one).
It saddens me to see that a studio that passed up on an idea years ago may take away all the money that rightfully belongs to a company that nurtured this project and believed in Lloyd and Larry. But I'm sure any one of us can name at least one travesty of justice far more egregious. Let's all hope that the judge will at least disallow any injunction by Fox to prevent the release of the film. I will rebut with three points;
1) Geeks have a lot more pull in popular culture these days.
2) Seeming like a typical comic book knock-off is not a bad thing anymore. Spider man and the rest are main stream.
3) Naked Blue Guy is going to get a LOT of free press, and it is going to get a lot of people watching it out of curiosity.
