It was inevitable that a cam of the movie would come out quickly and for Fox to make a comment and "punish" an entire countries "reputation" due to one cam leak is both ignorant and pathetic.

If someone steals your car you have no car. You can show a actual loss. (eg. value of the car)
If someone downloads a movie the studio still has the movie. How do you measure the loss? $9.00 for a ticket, $25 for the DVD? Also to have an actual loss from the download the downloader would have to have been willing to pay for it if they couldn't download it.
