It's similar to the BSD license in that derivative software doesn't have to be open source. The GPL requires derivative software be open source which is the "viral" thing Microsoft likes to rant about.

It is my understanding that patent law goes both ways. In order for Microsoft to maintain its patents, they are bound by law to sue those that infringe. It isn't like open source in the long standing definition of the term. Microsoft said they were going to kill open source. Their tactics in the past were to embrace, extend, extinguish.
Microsoft's embracing of open source to date really has been an opening of the source without the ability to take from it and re-use it in any way in a product and on another platform.

Open source is nice, but providing open standards so that any software can access their proprietary systems would be a great leap forward. Then they can focus on making their products better than the competition, instead of locking customers into their software so they have no choice.
