As early as 2002, a court rejected Microsoft's claims, stating that Microsoft had used the term "windows" to describe graphical user interfaces before the product, Windows, was ever released, and that the windowing technique had already been implemented by Xerox and Apple many years before[1]. Microsoft kept seeking retrial, but in February 2004, a judge rejected two of Microsoft's central claims[2]. The judge denied Microsoft's request for a preliminary injunction and raised "serious questions" about Microsoft's trademark. Microsoft feared that a court may define "Windows" as generic and result in the loss of its status as a trademark. In July 2004, Microsoft offered to settle with Lindows.[3] As part of this licensing settlement, Microsoft paid an estimated $24 million cash (for a case that Microsoft itself brought), and Lindows transferred the Lindows trademark to Microsoft and changed their name to Linspire.

If i want to FTP something, it's gui driven.

Vista is, so far, a non-starter. People APOLOGIZE to me for "upgrading" to Vista. It's a support nightmare in the works. It's "pretty" like a whore - glitzy, and ugly all in one.
Which I wouldn't care about except that it's incessant "you just clicked on a button, do you want me to let that button get clicked" interface dulls any meaning to real security, while disabling standard interfaces long used by programmers to actually get stuff done.
It's a mess. OSX is so much more beautiful, and Linux is to Vista what a train wreck is to Nirvana.
God, I hate Vista. Ever try to support it? It seems like MS has randomly disabled stuff just to make life harder. Bhawhwhw! - stutimandal, on 10/10/2007, -13/+21Oh come on. Vista is crappy enough to be copied. Create something new, something different.
How about a 3-D cube like desktop rather than the plane that we see? So much extra screen space, so many layers to navigate inside, 100s of windows can be opened in different sheets stacked up to make the screen.
This type of OS will be worthwhile with quad cores and 8 cores processors about to hit the market in a grand way.
