If Linux would be accused of copyright infringement developers would be able to remove the offending code in 2 minutes, with patents is more complicated because if Microsoft decides to exercise its ridiculous patents: (something like 20 patents regarding moving the mouse cursor on the desktop) then Linux developers don't have alternatives...
Software patents are by default ridiculous, they should not exist. It gives out patents on far too general things and in software in particular there are only so many ways you can do something. MS is claiming they own this stuff, but i am willing to bet most of the things they're claiming they have copy write to was in Linux long before it was copyrighted by windows. I really think the Linux users should sue microsoft over their copy write violations... see how MS does when it has thousands of lawsuits against it for copy write infringement over things they stole from Linux... well not really stole probably invented independently, but if they're going to be jerks over that stuff to Linux then Linux should be jerks right back to them and sue them over the same type of ridiculous patents... maybe when all the OS's of the world are about to be shut down over copy write infringement people will realize that this must stop and loosen up the standards and copy write reform will finally happen.

You could imagine the uneducated public thinking "oh, Linux is a Hacker Tool, it violated over two hundred patents." Likewise MS could attack the small distros and users in hope of driving them out of business. It's a last ditch effort that probably won't work if big Linux users step up for the good of the entire community.

Now they're hoping this "impending doom" scenario will scare Dell shareholders into forcing Dell not to go down the Ubuntu path until these "legal issues" are resolved. Sorry this kind of news really upset, I can't believe how they hinder improvement fighting dirty war instead of making their programs better. It feels like they just agreed that they can't come out with something worth paying for, so they take the cheap way of fighting.

I wouldn't go jumping to such conclusions. My best friend is a patent attorney for the largest law firm in Chicago. He always says patents aren't worth the paper they're written on until tested in court. He invalidates patents all the time.
People seem to jump to conclusions about what is and isn't breaking the law. They either don't know or don't remember that new laws (like the DCMA) need to be tested in court before everything is all said and done. The RIAA is recently finding that the tactics they use aren't always right, that they can't just go suing anyone. They tried to get the courts to uphold that you are absolutely responsible for everything that happens on your IP address, however in recent cases the courts said you aren't. And soon we might find out that if they wrongfully sue you, they might have to pay your legal expenses.
Always remember, the attorneys for MS, the RIAA, and the MPAA are not looking for justice. They are paid to protect their clients interpretations of the laws and their client's interests - not yours - and you can bet they are always bending the laws in their favor. Judges are the final answer on the proper interpretations of law, not lawyers. So you can't always assume what the lawyers say is right, unless they can back it up with a ruling by a judge on a very similar to exact same case. - 21chrisp, on 10/11/2007, -0/+21@chingy1788
That's because an OS that may have been good for general desktops in 1998 isn't necessarily good now. People just use it because that's what they know. A LOT of people are switching to Mac, and Linux continues to see slow but steady growth on the desktop.

Patent attacks are generally a sign of desperation. If Microsoft were to launch an offensive like that, it would be done because they don't think they can compete long term. I imagine they would be about as successful as SCO. Just about all of the patents would have prior art.
