- acontorer, on 10/12/2007, -0/+20This appears to be a wrong summary. I'm not a good French speaker, but using Babelfish to look at the referenced document: "An amendment with the bill DADVSI, having for objective to assimilate to an offence of counterfeit, the edition, the diffusion and the promotion of any software likely to be used to place at the disposal of the information protected by the royalty and not integrating a tracing and inspecting device of the private use (technical measurement). Any software allowing the remote loading like certain software of discussion instantaneous (cat), any server software is concerned (P2P, HTTP, ftp, SSH...)." (From http://eucd.info/index.php?2005/11/14/175-exclusif-amendement-interdisant-les-logiciels-non-equipes-de-mesures-techniques)
In other words, the amendment is to prohibit software that views rights-managed content without cooperating in the rights-management scheme. This is far different from prohibiting free software! - iamagrenade, on 10/12/2007, -0/+4digging this article DOES NOT mean you endorse this practice. Thusly, , digg it so everyone can see this affront to humanity.
- kiteflyer, on 10/12/2007, -0/+3From what I can make the law deals with software that circumvents Digital rights management. I has nothing to do with availability of source code. I may be wrong, I only know Joual.
"assimiler à un délit de contrefaçon l'édition, la diffusion et la promotion de tout logiciel susceptible d'être utilisé pour mettre à disposition des informations protégées par le droit d'auteur et n'intégrant pas un dispositif de contrôle et de traçage de l'usage privé (mesure technique). Tout logiciel permettant le téléchargement comme certains logiciels de discussion instantanée (chat), tout logiciel serveur est concerné (P2P, HTTP, FTP, SSH, ...). "
in other words it's the sort of the stuff that was used against Napster. Wonder where they learned that from. - n8han, on 10/12/2007, -0/+3This story's gotten a little jumbled in translation, and before that in the (justified) motive of FSF France to get people excited. The law they're talking about is like the DMCA, and the amendment "lobbied for" is like the CBDTPA (link below). Free software isn't the target, it's collateral damage. Get mad, but at least know what you're getting mad about.
http://en.wikipedia.org/wiki/CBDTPA - kdehead, on 10/12/2007, -2/+4any of you idiots making comments about the French ever actually BEEN to France?
thought not... - there, on 10/12/2007, -0/+2This is just a "proposal" and most certainly proposed by big American software companies like MS. This has a much lower chance of passing in France than "intelligent design" being taught in Brooklyn.
Half you guys are bigots keen on perpetuating stereotypes and divisions in the human race. Fortunately most people aren't stupid enough to believe the french-haters here represent all Americans.
Try and keep the racism and flag waving down to a minimum. Your making fools of yourselves and embarrassing your fellow countrymen. - inactive, on 10/12/2007, -0/+2this is only a proposal, nothing has been passed into law yet. There are thousands of ridiculous proposals being submitted to the law making bodies worldwide. When the French parliament pass this into law, then I will worry. But for now, this is nothing.
- joeyjojo, on 10/12/2007, -2/+4"So lemme get this straight.... If i produce a piece of software or music and I WANT people to share it ....I'm not allowed???
Ummmmmm....great.. WTG assclowns"
So lemme get this straight, you comment on an article based on the overly editorialized headline, don't read the comments, don't read the article, and instead just call everyone assclowns.
assclown. - ohcoaster, on 10/12/2007, -0/+2"French government bribed to ban free software"
- sirplus, on 10/12/2007, -0/+2thanks acontorer, this seemed a little too weird to be true. besides if they did ban open source, what difference would it make? that's like trying to outlaw air.
- tigerpaper, on 10/12/2007, -0/+1Well said FredB7. Don't people know that the internet isn't the place for pointedly xenophobic and bigoted comments?
...Save that stuff for calling into a AM talk radio station. I mean, come on, you have to think of your audience here - ColdChilli, on 10/12/2007, -0/+1Solution: Charge $.001 for your software.
Just never collect. - xutopia, on 10/12/2007, -0/+1The law is to stop giving away source code or programs which allow IP theft. It is directed towards Gnutella and the like, not towards linux and other open source projects.
I know this because I read it in my mother's tongue... ;-) - drn666, on 10/12/2007, -0/+1God.. everyone Undigg this so the moron who posted it learns a lesson about UNDERSTANDING THE DAMN ARTICLE he's posting first.
Another useless, sensationalist, misleading, totally off-base subject on a Digg article. Surprise, surprise. - brainache, on 10/12/2007, -0/+1Ok, just to clarify :
"An ammendment to the DADVSI law, with the objective of classing the editing, distribution and promotion of all software capable of being used to access copyrighted information (not including a tracing and testing device for private use [this bit i am unsure of])as an offence under the law. All software permitting transmision and downloading of material, including certain Instant Messaging (chat) software, and all server software (p2p, ftp, http, ssh) is affected."
This is my translation of the opening paragraph of the following article: http://eucd.info/index.php?2005/11/14/175-exclusif-amendement-interdisant-les-logiciels-non-equipes-de-mesures-techniques)
I am not a perfect translator, but i really cant see how this means they will be outlawing OSS.
The article goes on to say about the control and the obvious problems this law will cause for the innovation of new software with new features which allow the transmision of information and data which could be copyrighted via the internet. It also talks about moral rights of software designers to design and publish software.
Interestingly it also says something about "Any software which does not load(?) (they use the french word embarquant which means to embark, but that makes no sense) Microsoft, Sony or Apple spyware will be illegal. THe original franch was "Tout logiciel n'embarquant pas un logiciel espion Microsoft, Sony ou Apple sera illégal." Im not sure how to translate this, but it says something about Spyware (logiciel espion).
Anyone else with a better knowledge of french help me out? - MrPhelps, on 10/12/2007, -0/+1Whow the DMCA-like copyright law and now this ... no wonder people are rioting ;)
- F00b4r, on 10/12/2007, -0/+1Lamed it because of the absolutely inane summary. This is the worst reporting I have ever seen on a blog.
- republicoftexas, on 10/12/2007, -0/+1"Any Frenchmen around want to comment on what is going on? French government paid off?"
Sorry, did not see the comment mumulon made. Thanks for addressing this. - mumulon, on 10/12/2007, -0/+1hello I'm french, huhu. So please excuse my poor English.
Lots of bad things were said here, as usual there is a big confusion between the inhabitants of a country and their government decision...
First of all, our government is not socialist, but more like your George bush except it is less right oriented, and we do have a clear separation between religion and state.
Then about the riots, it seems that your TVs showed it was war here, but the trouble were only located in a few places, and except the two young boys that died by accident in power supplier equipment, no other people died... and there was no car burning in the center of Paris. A Time journalist made a comparison about the situation of minorities in your country and in mine, and it was clear to him that the situation was less difficult for them in mine. We don't have gangs and you can't get a gun as easily as in yours. But don't worry, if Mr Chirac and his friends continues to ignore the minorities, we expect a similar situation...
About racism, we do have racists of course, but the thing about the head scarfs is a very complicated problem, because our school is free for everybody and non religious. I don't have a very clear opinion on the subject but I do think that if you don't allow a head scarf for a girl, you have also to forbid the christian cross and any religious sign.
To finish, this law proposal is awful of course, I do agree with everybody, but like in The US, the lobbying of big companies such as Warner or Microsoft seems to be more influence on the government than common sense. - sporkman, on 10/12/2007, -0/+1WHAA? that makes no sense at all. why would they do that?
- MrCobaltBlue, on 10/12/2007, -1/+2But I'm le tired.
- FredB7, on 10/12/2007, -0/+1I'm disgusted by the number of comments full of xenophobia and stupidity.
Welcome to the cyber stone age. - Tufriast, on 10/12/2007, -0/+1It will be squashed, especially since the EU has said free software will be 100% legit, and usable in w/in the EU.
The bill goes against the whole of the EU, therefore will not get the light of day at all. Mandriva is also based out of France. So, yeah, this will die. Fast. - there, on 10/12/2007, -0/+1"sorry to break the news to you: Racism have never disappeared."
Thanks Sherlock but if you read my comment I never said it did. It's an uphill battle that will still take decades, maybe even centuries longer.
All we can do as individuals is stick out our necks out and speak out against it loudly when we are faced with it and hopefully one day the world will be cleared of this eugenic plague. - kiteflyer, on 10/12/2007, -0/+1http://eucd.info/petitions/index.php?petition=2
"Pétition demandant le retrait de l'ordre du jour parlementaire du projet de loi DADVSI"
just in case you actualy want to know what is going on. - v3xt0r, on 10/12/2007, -0/+0another reason I'm proud to be an American! =)
- there, on 10/12/2007, -0/+0
First off I'd like to say I'm a huge advocate of open source since the alternative will invite government, companies and individuals to perpetually insert "special code" (ala Sony). The temptation is too great with little chance of getting caught. (Sony was just careless it could have been much sneaker considering DMCA). Therefore I look at open source as a form of full disclosure.
Furthermore it's foolish to suggest someone can't freely design software and then distribute it. Considering the internet--it's completely unenforceable and makes lawmakers appear quite ignorant. (not a good thing)
I could understand if you disagree with the government but the French government much less "France" didn't decide anything with regards to this. It's only a proposal. How many proposals for outlandish laws exist in the US? Sometimes some of them pass in one jurisdiction or another. This is not indicative of the thought processes or capabilities of every man or woman in a particular state though.
Even the US sold Bin Ladin weapons but even bringing up the subject and other French faux pas suggests your looking for reasons to justify your hate.
From my perspective at some point you've let yourself become a bigot although somewhere in your words I don't think you meant to. Anyhow this is off topic and I've said all I can. - darkvad0r, on 10/12/2007, -0/+0Wow, you should really think about what you're about to post before actually posting it, there's a lot of racism on those comments, there's a lot of stupidity, there's a lot of "french are mean, ***** france" and I'm almost sure most of the people saying stupid things like that don't even know a french person nor have ever been to France nor have a clue of what is really going on there. So for god's sake: stop being such a bunch of ***** and keep your stupidity for yourselves.
- SatansMagicHat, on 10/12/2007, -0/+0"Actually the communist/socialist ideal is that everything is free. A dream world for communist is one without currency because everything is free and we all do our own part in society, yadda yadda yadda. Think hippy. Now do you think hippies want to ban free anything?"
Actually, the socialist party is part of their bicameral elections. In fact, they might be in power at the moment, I'm not sure. - there, on 10/12/2007, -0/+0
One last comment as I think there is hope for you yet.
There is no war going on at the moment. We all have negative thoughts but if everyone blabbers out whatever impulsive negative thought that comes to mind it won't take long to make one.
"pointing the injustices of others using their same weapons"
It sucks but that EXACTLY is what defines the good guys from the bad ones-- an attempt at restraint. You still have plenty of options as no invasion is imminent. Don't indulge in being a monster. It's ugly to watch , a debasement of yourself, and just breeds more hate.
Honestly I'm not perfect and won't pretend I know when negativity is appropriate but I can recognize when it goes way too far. And I'm not saying this stuff because I hate you (I don't you) but because I want to live in a gentler more tolerant world.
Tolerance doesn't mean you have to like or agree with someone. Life's tough and there are winners and losers. It just means you don't need to shoot down stereotypes at every opportunity. It is the destination we all wish mankind to reach and it begins with oneself before you can expect it from others.
Sorry if this sounds patronizing. It's just my point of view. - lampy, on 10/12/2007, -2/+2"Can you say communism?"
Actually the communist/socialist ideal is that everything is free. A dream world for communist is one without currency because everything is free and we all do our own part in society, yadda yadda yadda. Think hippy. Now do you think hippies want to ban free anything? - skyfex, on 10/12/2007, -0/+0Hmm.. So the summary and the english article is all bull? It should really be, "French getting DMCA"? Well.. It was bound to hit Europe at some point. Luckily, we Norwegians tend to be "lazy" in implementing these kinds of things. Come to think of it, that goes for all of Scandinavia (Piratebay anyone?)
- eMpi, on 10/12/2007, -1/+1"WHAA? that makes no sense at all. why would they do that?"
READ THE ARTICLE!! (and acontorer's brilliant refusal of the articles misleading summary!) Sheesh, I wonder if people actually do have the ability to read.. - locky, on 10/12/2007, -0/+0they need to kick out whoever wrote up and thought up this law
- duke_nate, on 10/12/2007, -0/+0Score one for Piracy!@!
- sporkman, on 10/12/2007, -2/+2READ THE ARTICLE!! (and acontorer's brilliant refusal of the articles misleading summary!) Sheesh, I wonder if people actually do have the ability to read..
I stand by my previously statement.
"whaa, why would they do that?"
because it's stupid that ANY government would put a control on publishing source code. - moose_diggs, on 10/12/2007, -0/+0So lemme get this straight.... If i produce a piece of software or music and I WANT people to share it ....I'm not allowed???
Ummmmmm....great.. WTG assclowns - c.trinity, on 10/12/2007, -0/+0Well,lots of hate against France,i see.Only if you live in Europe, you can actually know what's going on.The news are often exaggerated.
The article is misunderstood somehow.
You must understand one thing:
If people of France,Holland,Belgium...and so on,do not want something, then that something will never pass on.
Take as example the EU constitution which was fired by most of the citizens.
The article (the law),points to freeware/open source that makes possible hacking/cracking/and viewing/damaging/working around the source code of protected content.
I might misunderstand the article myself, but have a moment and think about it.
Does it makes sense to forbid all freeware ? - inactive, on 10/12/2007, -0/+0No offense to the french people but ***** the french government. VLC, the best media player ever might be discontinued because of this.
- Tufriast, on 10/12/2007, -0/+0Also, it should be noted that reverse engineering a format is legal...especially since many countries in the EU have done it in the past. Outlawing it in this manner is pathetic, and again, will fail.
- Tracon, on 10/12/2007, -0/+0just like most governments when it comes to the internet they have no idea what it is there saying. the pressure of the governments and industry are only going to force people to get better at hiding and sharing
- Corrosionx, on 10/12/2007, -1/+1The government of France finally succeeded into incorporating the worst of capitalism to the worst of socialism! Wow great job!
- there, on 10/12/2007, -0/+0"you "reap what you sow" and that have served France just right. Who were the ones that banned muslim girls from using head scarfs?, would you like Saint Patrick day banned because is not an American tradition?"
You're missing the point. Of course there are racists in France just like there are in America and every other country for that matter. Pointing out French racism as an excuse for American racism is a sure sign you have a bias.
There is no us and them. There is only we on this planet.
Some of us just happen to live in different jurisdictions. You can't lump people into one big container along colours, sexes, national borders, or whatever nonsense division you care to make. If you don't believe me then tell it to the tens of millions of people that lost family members during WW2 fighting the concept of eugenics and ultra nationalism.
You can be part of the problem or the solution. Up to you. - kdehead, on 10/12/2007, -0/+0"Jewish skullcaps.... you mean yamakas..."
no offense intended. i didnt know what the proper term was.
anyway this law has no hope of passing through parliament.
