And that move was one of the most insane things I've ever seen in sports. "Rule 75 in the NHL rule book pertains to unsportsmanlike conduct, including assessment of minor, bench and misconduct penalties for throwing objects, profanity, biting and hair-pulling during altercations."
That passage that you posted was added because of Avery.
He was breaking no rules, he simply was exploiting a loophole which the NHL just closed.

The only difference is that this guy was facing the goalie while he did it and waved his stick in the air. The guy doing the screening has now taken himself out of the play leaving you with 4 players anyway. You wanna waste a puck handler for that, fine. It's not going to work anyway. If you're out of the crease and not hitting anybody, do an irish jig for all I care. Don't turn hockey into a sport full of knee jerk reaction rules. It takes away from the game.

Avery was waving his hands and stick in front of Brodeur. He wasn't interfering with him physically, and everything listed in the rule prior to the change involved physical contact.
The refs didn't blow it by not issuing a call. They were right in letting it go as the rules stood.

In order for a rule to be changed, it must be put forth by the General managers (usually with input from the Competition Committee) and approved by the Board of Governors and (in cases concerning protective equipment) the Players Association. The wording was a memo to coaches, referees, and players on how the existing rule will be applied. The wording from Colin Campbell will be added to the referees' case book, which elaborates the rules with particular examples such as this.

There is nothing wrong with it. People stand in front of the goalie all the time; so he turned around. big deal. in fact, it seems like the obvious thing to do.

Avery on the other hand takes cheap shots and plays unfairly and when someone pisses him off, he just runs away so he can harass again on the next shift. When opportunity knocks, Avery is going to suffer a career ending injury from a clean hit.
- Kronos6948, on 04/15/2008, -1/+5The issue with what you quoted from the rule is that each instance cited in the rule involves some form of physical contact. By your interpretation, a player celebrating a goal can be considered unsportsmanlike conduct.

Screening the goalie is an important strategy for most teams and fans even get upset if their team isn't screening the opposing goaltender enough. Is the league's position really that players are allowed to block the goaltender's view as long as they pretend to be in the play?
The only difference here was that Avery was waving his arms around. -
