- goeric, on 06/07/2009, -0/+53That doctor should go to jail.
Doing a procedure he was not certified to do is reason alone to lose his license, but not disclosing this to the patient? Jesus christ. - arunforce, on 06/07/2009, -0/+41Wow.. Permanently disabled.
***** that doctor, no money can replace being able to move on a day to day basis. - jfield1, on 06/07/2009, -0/+36She deserved it.
(the money, not the coma/disability) - darkened, on 06/07/2009, -0/+26Normally I think many malpractice claims are pure bull ***** but this is absolutely abhorrent. I'm glad the system finally worked for her even though I don't think 3.5 million is any where close to what she deserves.
- gcnaddict, on 06/07/2009, -1/+22Before anyone pops in saying OMG SHE GOT 650K AND SHE SUED ANYWAY SCREW HER:
Read the article. Being permanently disabled and only receiving 650k *after* having damages valued at 1mil AND after a long delay... this isn't a frivolous lawsuit at all. It's perfectly justified, and while money most likely won't fix her ills in this case, at least she'll be able to afford what's needed to get her as close to normal as possible. - JoshCBFL, on 06/07/2009, -0/+14It's scary that there are doctors out there performing surgeries that they are not qualified to do. Always make sure to check credentials before undergoing any kind of surgery. It could be the difference between life and death.
- inactive, on 06/07/2009, -0/+13not if she was fat and that is usually what precipitates a tummy tuck, but a sane woman would have smacked the ***** out of a doctor when he said you know what, while I sterilize you why don't I try to make you moderately more attractive to me and possible to your husband as well, because that's basically what he did.
- merlinicorpus, on 06/07/2009, -2/+14Apparently this guy still is in practice. Unbelievable.
http://www.mccrackenkentucky.com/city/Paducah/busi ... - Llanowar, on 06/07/2009, -0/+11At least with this money she can "compensate" for what she now misses in life.
I'm not at all a sue happy person, but I think this is pretty much what suing is meant for. - SaladCactusKing, on 06/07/2009, -0/+11Hi Dr. Nick.
- whatthefu, on 06/07/2009, -0/+11Until they figure out how to make us cyborgs, that is.
- LeroyJenkems, on 06/06/2009, -2/+12In other words, don't do "tummy tucks" before you ***** yourself over.
- blackinthmiddle, on 06/07/2009, -0/+10FTA:
"Poppe said Daniels is still in constant pain and will be permanently at risk of medical complications."
She deserved a hell of a lot more. - christoast, on 06/07/2009, -4/+13HI EVERYBODY!
- kukurio, on 06/07/2009, -0/+9Cases like these are why we shouldn't put caps on malpractice awards.
(And before anyone tries to comment about how malpractice insurance is causing health care prices to rise, I'll remind you that that notion has been completely debunked.) - Klinky, on 06/07/2009, -2/+11One of many great stories of privatized "healthcare", which doesn't support either "health" or "caring" in many of these cases. Insurance may very well be one of the biggest frauds out there as these companies will do all they can to get out of paying what they agreed to.
I understand this was malpractice insurance rather than health insurance, but they sure seem similar in how they operate. - GeekNurse, on 06/07/2009, -0/+9Hi Dr. Nick!
- Renian, on 06/07/2009, -1/+9FTA: "leaving a basketball-sized hole in her belly 7 to 8 inches deep,"
Holy *****, wouldn't that mean she'd have NO MIDSECTION? - darkened, on 06/07/2009, -0/+7I can't even fathom how you could say this comment even if it was purely trolling.
- ChiaGod, on 06/07/2009, -0/+7They hire a professional to interview the Jury to determine the damages:
"Would you have your midsection removed and be in constant pain for ONE Klondike bar?....No? (writes on his clip-board)
How about Two...."
(Hours Later)
"Ok so we agree we would all do it for 6,936,241 Klondike Bars which comes out to... "
(adding machine sounds)
"$3,479,277!" - JoshCBFL, on 06/07/2009, -0/+6Anyone who does any kind of retaliation like that deserves to go to prison.
- AboveandBeyond, on 06/07/2009, -1/+7The verdict included $3,479,277 in punitive damages.
-----
How do they calculate the money to that accuracy? - calcm, on 06/07/2009, -0/+5What the hell is wrong with you? If this happened a family member you actually love you wouldn't be saying this. ***** off!
- inactive, on 06/07/2009, -3/+8You know whats real ***** up, most doctors in Kentucky are this way. It's ***** dangerous to have any kind of operation around here, I'm in eastern KY and some ***** amputated a mans leg at the knee in ICU without anesthetic, because they woke him up in the middle of the night and he was angry, he's still practicing so this doesn't surprise me at all, but it does piss me off quiet a lot.
- disrupter, on 06/07/2009, -2/+7That's alot of cheeseburgers
- kefkaantakrist, on 06/07/2009, -1/+6Great. They gave the guy ahead of me an extra packet of ketchup. Now I gotta pay more for my Big Mac to make up for it.
- r00fus, on 06/07/2009, -1/+6No, it doesn't change that, but the fact that some people have NO doctors, or that insurance companies basically own the whole show will change.
Besides, Klinky never even mentioned socialized healthcare. That's your strawman. - LightPhoenix, on 06/07/2009, -1/+6What is with that "Next Page" button that doesn't go anywhere? There's only one page.
- blackinthmiddle, on 06/07/2009, -0/+4Nope, there are indeed three pages. Use a different browser or something. It worked fine for me.
- Llanowar, on 06/07/2009, -0/+4It is scary that we would need to check credentials. Things like this should always be in order.
- piieerrrree, on 06/07/2009, -0/+4Stop using TinyPic.
- jfield1, on 06/07/2009, -1/+5***** yeah?
- JFitzpatrick, on 06/07/2009, -0/+3A hole in her stomach 7-8 inches deep? Jesus that was a hell of a tummy tuck... I just put my back against a wall and measured. An 8 inch hole in my stomach would put the hole somewhere in the drywall.
- guyincognitoo, on 06/07/2009, -0/+3They get paid so much because they go to school for at least 11 years. I'm not defending this guy, she deserves the money, but ob/gyn usually have the highest malpractice premiums, up to 200k a year in some states.
- GeekNurse, on 06/07/2009, -0/+3Sucks to be this guy: http://www.davidagrimes.com/ http://davidagrimes.wordpress.com/ same profession, practically same name, similarish location...
- dilbert, on 06/07/2009, -1/+4Why do doctors get payed so much? Wasn't it because of the risks? Shouldn't HE be paying her and not the insurer? Go sell your house, 'doc'.
- piieerrrree, on 06/07/2009, -0/+3I only buried you because you asked...
- gambyt13, on 06/07/2009, -1/+4This lady deserved every penny, but why is this asshat still walking the streets? Nationalizing healthcare would put backwoods meatball ***** like this guy out of a job - in any state - and possibly in jail. We need to standardize a level of care and a baseline proof of credentials. The rich lady doing an elective facelift in Beverly Hills and a poor welfare mom getting a hysto in Appalachia should both be able trust the person wielding the scalpel without having to hire a private investigator.
This would also go a long way toward standardizing award practices in malpractice lawsuits. Imagine if the barriers between judicial policies were lowered. Judges and juries would be able to review similar settlements in other states and consider them in making reasonable and fair awards. - paintmeprettyx, on 06/08/2009, -0/+2Oh god, this isn't too far from where I live. I really need to get the hell out of this state. I read an article on my local newspaper the other day about how some surgeon around here left a freaking sponge in this woman's stomach after surgery. Then my sisters friend had her baby a few months ago, and the OBGYN apparently didn't do anything right at all and ended up breaking the babies arm and both legs during birth. (Wouldn't do a c-section, even though the baby was stuck in the birth canal for a very long time.)
- Zippo, on 06/07/2009, -1/+3I hate insurance companies. Uncaring, greedy *****, every one of them. They pretend to be services to help people when they need it, but when it actually comes to helping people, they really don't give a *****. As far as they're concerned, actually giving out a claim is bad for business.
- GeekNurse, on 06/07/2009, -0/+1Y?
- JoeHague, on 06/07/2009, -2/+3I don't know how I feel about laws forcing insurers to settle in a timely fashion if they know the insured is capable. It's good to know that in cases such as this one, the injured will not be burdened with unnecessary litigation. But I have a feeling that these types of laws will force insurers to settle frivolous lawsuits, less they be susceptible to a double jeopardy, especially in states like Kentucky were people have the right to trial by jury in these instances/
- GeekNurse, on 06/07/2009, -0/+1
- inactive, on 06/07/2009, -0/+1cuz your picture didn't post. there's nothing there.
- brbubba, on 06/21/2009, -0/+1I agree. There's this ass-backward notion in the US that gross negligence and fraud in the corporate world isn't criminally liable.
- GeekNurse, on 06/07/2009, -0/+1it got removed by tinypic :(
- inactive, on 06/07/2009, -0/+1who would insure him now
- inactive, on 06/09/2009, -0/+1dugg.
- NBCLocal, on 06/24/2009, -0/+0Look at what happened to Kanye West's mother. Every doctor should be carefully vetted before they are allowed to cut you open.
