- rentmitchum, on 12/10/2008, -2/+95Marijuana being illegal in the first place is a violation of our rights.
- bradysbeau, on 12/09/2008, -1/+84Yes they violated his rights and so did the courts, the jury ect. If the PEOPLE vote for something... oh hell, don't the courts have real criminals they could be messing with. Leave it to them to go after the ones that can't defend themselves.
- inactive, on 12/10/2008, -2/+66Billions of $$$ wasted; millions of peoples lives ruined. I'm going to go buy about 35 gallons of vodka now though no questions asked! Dont smoke pot become a drunk, its legal! Also going to mix that with some HydroCodone (also legal) then finish that off with a nice toxic smoke of a cigerette... All legal!
- Tbyrd073, on 12/10/2008, -1/+48This is the stupid ***** that goes on with medical use of Marijuana. I don't understand why we don't get rid of the War on Drugs *****. Somehow I think the country would continue to operate.
- TheJimid, on 12/10/2008, -1/+47Patients' rights are violated on a daily basis. Look at what happened to poor Jonathan Magby.
http://stopthedrugwar.org/chronicle_blog/2008/dec/ ... - billraydrums, on 12/10/2008, -0/+33Oh really, did they? So explain how Carl Sagan, one of the most brilliant minds of our civilization managed to be a raging pothead and still change the way we perceive outer space.
That's right, you can't. Have another drink, Kennedy.
Oh and everything you listen to musically? Hate to spoil it for you pal, but Mary Jane's had her hand on it. I don't care if you listen to traditional country or even the most holy rolling gospel music, pot's put a stamp on it.
Your picayune attitude is precisely why alcohol-related deaths continue to climb in this country. Digg me down all you want, I'm just sayin. - inactive, on 12/10/2008, -2/+29Whenever the legal consequences of a substance [marijuana] become more harmful than the physical consequences of the substance's use, there is SOMETHING WRONG. Why can't the government grasp this elementary concept?
Furthermore, they were charged with the "manufacturing" of marijuana? What the *****? If growing a plant is "manufacturing" something, then Jesus Christ, I guess botanists are part of industry! - ATLien74, on 12/10/2008, -1/+28Health has nothing to do with why marijuana is illegal, because if it did, tobacco and alcohol would be listed as far more harmful substances. It's fear. Fear, that it will cut into the profits of other legal substances and pharmaceuticals, if not out right replace them. Fear, that it can't be taxed or controlled since it's so easily grown.
- Mujokan, on 12/10/2008, -3/+23So the court can second-guess your doctor on what is a "debilitating medical condition". How is the law supposed to work, then? You have no idea whether your card is valid until you lose a case in court.
This should be open-and-shut. If the doctor says OK, that is good enough. Otherwise the law is worthless. Whether your condition is "debilitating" will depend on whatever judge you happen to run up against that day. - inactive, on 12/10/2008, -2/+21Ohh, so according to the DA, it is up to THEM to decide whether or not marijuana can treat depression and anxiety?
Uhmm... no.
The fact is that he was licensed by LAW to use it, and he was prosecuted for doing so. Complete ***** *****. - Phalanxia, on 12/10/2008, -1/+19Nice. Pity there's hundreds, if not thousands of others who's rights are violated and who we hear nothing about.
- goodinohio, on 12/10/2008, -1/+17The government confiscates 400billion a year from us to chase pot heads around.
- squoob, on 12/10/2008, -1/+17I am exceedingly disgusted by the tiresome, failing, flailing, pathetic, ignorant & revolting War on the People.... the War on "drugs" is an utter failure. It is completely out of control. I have zero respect for anyone who "just enforces the law - because it's the law!" ***** you. It is unacceptable to bust people for pot. Get a life DEA. Get a brain Feds. Legal by state but bustable by feds. What a nice arrangement that must be. Ruining people's lives over marijuana. It is ludicrous. There are none so blind as those who will not see.
- jessehadden, on 12/10/2008, -1/+16In America, you can be legally assaulted and put into a cage for taking a medicine. An ancient, natural, herbal medicine.
Freedom my a**. - kemp34, on 12/10/2008, -1/+15Yep.
Big Pharma is scared of marijuana, they want you sick and taking their pills chronically.
Big Prison/Court Complex would lose a major portion of its busy work.
Big oil, steel, cotton, etc. would have to compete with an easy-to-grow, amazing renewable resource.
Big alcohol and cigarettes would be exposed and possibly lose out on customers.
Marijuana and hemp in general are illegal because of these special interests, NOT because of any sensible argument in favor of the ethics of prohibition. - Mujokan, on 12/10/2008, -1/+15It's Washington State , not CA. You are allowed to grow up to 15 plants. As for the warrant, it's not case closed till it's been through the whole system. That is what appeals are there for, unless you are against the appeals system.
- GonzoAKQJ10, on 12/10/2008, -1/+15Why can't cops get it through their heads that weed can be legal. LET IT HAPPEN!!
- sodade, on 12/10/2008, -2/+15I think that the lawmen are getting scared. They've know for ages that cannabis prohibition has a relatively low risk to enforce - thus making it an easy job justification. If pot were legal the # of drug related busts would be massively lower - thus justifying less of their jobs and making them have to focus on busting real, dangerous criminals.
- kemp34, on 12/10/2008, -0/+12Not just continue to operate, but flourish much more than it does under draconian laws stifling a natural plant with medicinal qualities.
- redgiemental, on 12/10/2008, -2/+13Doesn't that mean there is no legal way to obtain the marijuana though?
I'd prefer to grow my own than visit a drug dealer. - keyforce, on 12/10/2008, -0/+10Low hanging fruit.
- Coinspinner, on 12/10/2008, -0/+10$Billions and years wasted chasing around a helpful plant.
Oh, and the plant is winning. - Snyz, on 12/10/2008, -2/+12Weed and hydrocodone sounds godly. Alcohol and hydrocodone sounds deadly.
- MeatPlow, on 12/10/2008, -10/+19That guy in the picture has a really long finger.
- whoizthedrizzle, on 12/10/2008, -0/+9cuz they think we slow and easy to catch
- bkrejchi, on 12/10/2008, -0/+9Keep in mind that a true conservative should be anti-drug war and would not approve of government getting involved in everyone's lives. Also, until the 30's when it was criminalized the conservative standpoint was to leave it alone. But alas, you're right, it is the Republican and Democrats stance now to wage war on plants. (Joe Biden wrote the minimum sentencing laws). At least the republicans have a war to fight that could be hypothetically won.
- inactive, on 12/10/2008, -0/+8This should not be going to court. With that said, if they are going to press charges against someone, press charges against the doctor if they think it was wrongly prescribed.
Law enforcement and the court system should definitely NOT be getting involved. - Layne, on 12/10/2008, -0/+8The majority of people have something illegal in their home. Drugs, fire code violations, pirated media, whatever.
- kushin, on 12/10/2008, -0/+8nevergetbusted.com
- oldhick, on 12/10/2008, -1/+8Further, even if his activity was criminal, they need to justify the search warrant and anonymous tips don't cut it.
- inactive, on 12/10/2008, -1/+8Buried for being wrong.
- Mujokan, on 12/10/2008, -1/+8It's legal to grow your own there (with card obviously).
- squoob, on 12/10/2008, -1/+8You equate that because someone wants to legally smoke pot without the 'risk' of being busted that they are an addict? Even if they "develop" a malady - who cares? Why do you care? What do you know about drugs? What do you know about marijuana? What do you know about 'classical" drug addictive behavior.
Yes, loading up our jails with an endless amount of people that have committed NON VIOLENT, victimless crimes.... gee, what a great idea! And look where that has gotten us today. Jails full of people that should NOT BE in jail. *****. I'm so tired of these prohibitive, ignorant opinions. Please. But I'm not down modding your ignorance as you are entitled to your (albeit wrong) opinion. - ParanoydAndroid, on 12/10/2008, -0/+7My understanding, and I could be wrong, was that the search was illegal because they had no probable cause to enter the apartment. The smell of marijuana and the reported usage were all explained by the doctor's note. Since the warrant was therefore not based on probable cause, anything found in that apartment (including illegally grown marijuana) must be thrown out as fruit of the poisoned tree.
- Frankyfan3, on 12/10/2008, -0/+7But, it is a good avenue for spreading the word, and letting anti-prohibitionists know that they're not alone.
I've written my representatives numerous times, and I donate to NORML, STOPTHEDRUGWAR & MPP ... and haven't missed a Seattle Hempfest in years!

What are you doing about it, other than telling people Digg isn't the avenue for change?

I think his argument is... I have medical authorization to obtain pot. Usually goes along with being allowed to grow some too. So you are so very wrong here.
Cultivation guidelines:
"The Medical Marijuana Act addresses cultivation only for one’s own personal consumption. There is no concrete standard for numbers of plants, but there is a sixty-day supply limit written into the new law. If arrested, a patient may need to show that they do not possess more than is necessary for their personal sixty-day supply.
Patients are not allowed to give away, distribute or sell marijuana under any circumstances to anyone. Any evidence of such distribution puts a person at very high risk. The Medical Marijuana Act defense will not work for someone who distributes or sells any amount of marijuana, because the new law applies only to a patient’s personal medical supply. If prosecutors discover evidence of sale or distribution, they can charge a person with felony counts that could result in years of prison time, regardless of that person’s medical condition or medical authorization to use marijuana." - Frankyfan3, on 12/10/2008, -0/+6Write your representatives and tell them it's time to tax & regulate... not incarcerate!
- NikoKun, on 12/10/2008, -1/+7What a crazy post... And quite wrong too.
But I'll just ignore that, and instead ask, Why is an anonymous tip that Marijuana might be growing somewhere enough to give police a reason to ransack your house, destroying everything, violating your rights, and possibly killing someone or a pet in your household in the process, as they often do...? - Black6x, on 12/10/2008, -1/+7[Citation Needed]
- sajorojas, on 12/10/2008, -0/+6Well now you know.
- TekTrixter, on 12/10/2008, -1/+7how was he violating it? If the doctor gave him a prescription then he was within the word of the law. If the doctor was wrong to prescribe it then it is the doctor that should be in trouble, not the patient.
- yuravian, on 12/10/2008, -1/+7Mujokan, in Cali you can grow up to 6 plants, or more if you get special permission from the doctor who gave you your recommendation.
- MWeather, on 12/10/2008, -1/+7THC is a neuroprotectant, dumbass.
http://www.jneurosci.org/cgi/content/abstract/21/1 ... - AZExile, on 12/10/2008, -1/+7but the evidence should be thrown out because the officers had no probable cause to obtain a warrant.
Those laws are there to protect more than just potheads. They're there to protect every day people like you and me. EVERYONE - not just people who smoke - should be outraged by this. Courts not upholding probable cause is a scary scary thing. - drakethegreat, on 12/10/2008, -0/+6This is absolutely retarded. If my doctor prescribed me a pain killer that isn't over the counter and illegal to possess without a prescription and I didn't realize that the diagnosis was wrong then they wouldn't charge me for possession... This is entirely based on people's predisposition to hate anyone who smokes marijuana and nothing more. Seriously ***** you eastern Washington.
- hellbent187, on 12/10/2008, -0/+6Sounds like a classic case of "illegal search and seizure" to me. I hope the higher court throws the case out. Also, Michigan just passed a law to allow the use of Medical Marijuana and it's perfectly legal to grow it. With a doctor's consent of course.
- ninjad, on 12/10/2008, -0/+5***** THE DEA AND ***** HENRY ANSLINGER FOR BEING A FASCIST PIG
- lostsymphonies1, on 12/10/2008, -1/+6In Washington you can grow your own medical marijuana. You're allowed a certain amount growing and a certain amount harvested.
- inactive, on 12/10/2008, -0/+547% of the U.S. smokes marijuana and rising. These 47% are considered criminals. We need to do something now.
- TritonX, on 12/10/2008, -0/+5Because cops aren't chosen for their ability to think morally, they follow order and whatever is the law even when it doesn't make any sense.
