The person isn't being punished because he has a disease. He is being punished because he assaulted someone with it.

Because your comment was idiotic. You cannot get HIV from someone merely preparing your food, unless perhaps they are bleeding profusely into it. As for this case, nine years is not long enough. This guy should not be allowed treatment or palliative care for his disease. THAT would be appropriate. - geminitojanus, on 10/12/2007, -5/+17With AIDS, not very long, bu this person didn't necessarily have AIDS, he has HIV, the virus that causes AIDS, and people with HIV haven't outlived their drug regimes for the most part; they either die of other infections (people with HIV are often not the healtiest of people in the first place), cancer, or they die of car accidents, etc. Some computers have predicted people can live about 30 years on the cocktail vs roughly 10 without it.
Besides that, he's in prison, which means he'll be getting his medicine on time, every day for his entire stay, courtesy of the State. Free HIV treatment to extend his lifespan beyond that what he would have lived /not/ in prison. Can't really beat that. I would have rather have seen this guy put to death, giving someone a deadly virus is as good as shooting them and watching them slowly (9 years) bleed to death. Oh also they can pass the poison on, so they have to be careful with who they contact intimately from this point on also. And the guy doesn't explain all of this to the girl. The girl, eager to try some new drink, drinks it, gets the poison, and her life is now unnecessarily harder than before. It's kind of similar, if not the dumbest metaphor ever. People should know that taking someone's word on something like that is not sufficient. If he hadn't gotten tested we would be saying that it was a different story. To me the problem here is that people entered into a relationship involving unprotected sex without getting tested first and making a commitment to each other.

However this is a good cautionary tale for those who take the status of their partner(s) for granted, and for those who don't realize the value of safer sex practices even if you think you know the status of your partner.

Otherwise, you should operate under the assumption that your partner is infected and take all necessary precautions. "He looked healthy!" is not an excuse after the fact. Since he had prior knowledge of his status, this douchebag deserves his prison sentence. But since the sex was consensual, the woman bears some responsibility here.

I'll agree that the guy is slime and should have done the right thing, but it works both ways. She should have been diligent in protecting herself if she cared for her own well-being.
I just hate when I see people jump for the... "he/she must be killed for their crime". Don't be so quick to deal out death and punishment. -
