Things are so upside-down lately. - MustacheFace, on 11/13/2009, -1/+23The title is a bit misleading. There is no evidence that the doctor used his own sperm. He had a history of negligence, particularly when dealing with properly labeling sperm samples. It seems the couple freaked out, made a baseless accusation, and upon learning the truth (that he used the wrong sperm because of his unobservant Mr. Magooishness) were willing to reach a settlement. Otherwise, why would a case with such severe ethical violations close so abruptly? If there were malicious intent to begin with, I seriously doubt the doctor would have targeted an interracial couple, which would have made it incredibly easy to get caught.
The most logical scenario involves the following: doctor uses wrong sperm - angry couple finds out, then accuses doctor of worst possible infringement for lawsuit with highest efficacy - doctor settles suit, judge issues gag order so initial accusations don't add fuel to an already unpleasant situation - media sees gag order and focuses on the initial accusations since they cannot legally solicit any new information from the parties involved = media uses hearsay to deduce that the doctor willfully used his own sperm and was somehow allowed to keep his practice.
