Instead of incriminating potential buyers -- the system needs to be reinvented to take into consideration that the model has changed. It's much more beneficial to a music artist, for example, to buy their CDs at their concert so they actually get the money.

Good thing I saw some of their content for free on Digg a few days ago... and then told a few friends... or I might not have bought that book... and they might not have bought a DVD set of the Red Green show... Hell... I bet if some people hadn't seen it for free online about a week ago... This post wouldn't even make sense to them... but it's great that through the miracle of the internet, artists reach audiences they never before could have dreamed of, where free promotion brings in a hell of a lot more money than the days of the luddites, when people had to buy your stuff to find out if they even liked it. And you may be thinking, $10-$15 for a person to download movie and music unlimited, that sounds like a bad idea thats barely any money at all. But thats $10-$15 more than they are making off of me now...

The servers were theres, but who's are they now? Not theirs! The Fine - a measly $100k, which if paid is negligible in comparison to a fine in the U.S, plus they have clean records, so if they are sentenced nothing still may come of it.

If they never took napster down we might still be using centralized trackers with a true one peer to one peer System (Not the current PPPPPPPPPPP2PPPPPPPPPPPPPPPPPPPPPPPP systems we use, the death of napster introduced the golden age of music, movies, games, books, and porn, all being shared at once, between thousands of users simultaneously, with decentralized trackers much more immunne to litigation.
The death of napster was the best thing to happen to piracy since dual cassette tape decks. If napster did not die, we might not be using bittorent and getting 1000KBPS+ speeds on our linux distributions today. While they at it, why don't they ban DVD players since they can be used to view copied DVDs or ban the telephone since you can talk about confidential information through it? I spend an absurd amount of my money on buying TV boxsets, DVDs and CDs, but I'm also an avid bittorrenter, and the former is a direct consequence of the latter.
