1. You can not sell something on eBay that you do not own.
The seller does not own the picture and therefor does not have the right to sell it. Anywhere.
2. The actual description goes in that box with the that says "Description" and the description is for a "Video Game System"
It also says "Seller assumes all responsibility for listing this item." Since the description is listed falsely, the bidder does not have to pay.
Everything else is extra to the main description.
This aside, the buyer is a moron for bidding without reading every detail on the page. If he were forced to pay up...i would not pity him.

I guess the end of time has come and gone then - 'dude'. The Canadian dollar has been valued higher than the USD on many, many occasions in the past. The current thinking at The Bank Of Canada delibrately maintains the currency lower than the USD to keep the trade deficit on the US side of the boarder. I don't necessarily agree it's good economic policy but it is what it is.

Additionally... In the US all legal notices MUST be written in a font size greater than or equal to nine point. Anything less than 9-point type is not legally binding text. Ask any lawyer. I'm going to assume Canada has a similar law... otherwise people would put 2-point disclaimers on their products all the time. I disageed with eBay on the XBox box, because in that auction, it was clear from the title what it was-- and the description said in multiple places that the auction was not for a console, but for an empty homemade box. I think that the seller was more than clear of what it was, and the buyer should have had to pay for it. I just had two auctions removed for excessive shipping costs ($50) to ship out two laptops. Sent Ebay an expletive-laden response asking what the ***** their problem is ? It's not unreasonable to pay $50 for shipping laptops.

The item and description both list PS3 AND he lists the systems specs under the description. the seller was just being an asshat.

Bottom line, who cares - what difference does it make what rating you have on eBay anyway? eBay is no longer the common man's marketplace; it's overrun with thousands of script-generated auctions promising to make your "p3n1s" bigger or selling the "secret" that will unlock your financial freedom. It's nearly impossible to find a good deal from a good person.
