Regardless of his description of the item, by using the stock photo he gave the buyer a strong case for getting his money back. I've heard of people having their ebay accounts revoked in similar instances.

The reason why most Ebay scammers don't get prosecuted is becuase they only have one victim, who usually is satisfied with just getting the auction invalidated and not losing any money. But if a major store does it, there are lots of victims, and only one has to want to pursue legal actions.
I DID press charges agaisnt someone on Ebay who took money from me and did not send anything. I gues he thought that since the item was a cable descrambler the people he stole from would be afraid to report it. It was a Dutch auction too. Three of us knew that there was nothing inherently illegal about what WE had done, and when the idiot actually cashed on ofthe guys' checks, we had his name and address. We called him and explained what we were going to do and he told us to go right ahead. So we did.
This ***** then turned what would have been nothing more than a fine and probabation into 3 years in jail by threatening me by phone (and like an idiot, leaving it on my answering machine!) after he was contacted by police to come down to questioning.
So yes, people DO go to jail for things like this. It is just more rare becuase of hte numbers of victims.

While itwould be more effective if the buyer was the one who pressed charges against you, technically ANYONE can do it. Even anyone on Digg. So, by your bragging, you re only making it more and more likely that one of the hundreds of people that visit this page will give the NYPD a call. Oh, and since the seller was in another state, it becomes a federal crime. A SLIGHTLY worse scenario for you.

Assumptions by the bidder because of current product trends don't make it fraud.
And just because the bidder didn't have the common sense to actually read what was being bid upon doesn't make it fraud either. It makes him stupid and reckless with money.
That said, I do feel bad for the bidder because it was a pretty harsh way to learn a pretty obvious lesson. :-\

Or that eBay should cancel all transactions where people agree to pay a large sum of money for an old item? As far as eBay is concerned, the bidder could just be a collector of old game systems.

If your not careful, eBay can be be a real Land of Confusion. The buyer should have
read the fine print. Seems like the seller knew he was gonna get poor soul.
Another good one is "Going Out for Business Sale", that really lures the folks - vhold, on 10/12/2007, -1/+3So, just for what it's worth.. all the ways this is fraudulent.
"HOT ITEM! Not PRE-ORDERED..HAVE IN HAND"
Only makes sense for the PS3, not the playstation.
"THERE IS NOWHERE TO FIND EVEN THE 20GB SYSTEMS THIS CHEAP....BUY THESE INSTEAD!"
Implies that it is the other version of the PS3.
"You're bidding on Sony Playstations, 3 of them."
The only straight out truthful statement, but he puts it almost half a page down from the "FREE SHIPPING" comment, which makes it seem he is purposefully trying to make it so that people don't see it, and scroll back up and bid instead.
All of that combined with a buy it now that is blatantly too high, it's clear he is trying to mislead the buyer, so I don't think the buyer is going to have much problem dealing with this. - BigEazy, on 10/12/2007, -0/+2He should have just gone above and beyond, by selling 4 Sony Playstations.
