The draconian policy of "buyer beware" is dumb, imagine going into a store and them saying "We can offer you a brand new playstation, but you have to buy it in a bundle for $1000" You then say yes, get home and find out they sold you a PSone with 20 or so games.
Is that a buyer beware? Or does some blame fall on the seller? The reason why most Ebay scammers don't get prosecuted is becuase they only have one victim, who usually is satisfied with just getting the auction invalidated and not losing any money. But if a major store does it, there are lots of victims, and only one has to want to pursue legal actions.
I DID press charges agaisnt someone on Ebay who took money from me and did not send anything. I gues he thought that since the item was a cable descrambler the people he stole from would be afraid to report it. It was a Dutch auction too. Three of us knew that there was nothing inherently illegal about what WE had done, and when the idiot actually cashed on ofthe guys' checks, we had his name and address. We called him and explained what we were going to do and he told us to go right ahead. So we did.
This ***** then turned what would have been nothing more than a fine and probabation into 3 years in jail by threatening me by phone (and like an idiot, leaving it on my answering machine!) after he was contacted by police to come down to questioning.
So yes, people DO go to jail for things like this. There were other 0 feedback users bidding on PS3 related auctions too; some did good, others did evil. The good guys went around a bid up/buy it now'd auctions that were trying to deceive people. The bad ones bid up perfectly honest auctions to ridiculous prices...

- CielChocobo, on 10/12/2007, -7/+15It sounds like an idiot described the auction. However, it's legit, in that everything it says is true. It clearly says $900 for three Playstation systems. It says to get the three systems -instead- of the system with the 20gb drive. Take every word literally, and it's just an expensive bid for three older consoles. He's going to get exactly what he bid for. I'd say the bidder has a lot of cash and just didn't do too well in English class.

- daigakuinsei, on 10/12/2007, -0/+6The fact that he used stock photos of the PS3 when he wasnt selling one is against ebay policies. Regardless of his description of the item, by using the stock photo he gave the buyer a strong case for getting his money back. I've heard of people having their ebay accounts revoked in similar instances.
