Your use of the Service is subject to the Code of Conduct. You also agree not to do any of the following while being connected to the Service:
-Create a Gamertag or use text other profile fields that may offend other members. This includes comments that look, sound like, stand for, hint at, abbreviate, or insinuate any of the following: profane words/phrases, sexually explicit language, sexual innuendo, hate speech (including but not limited to racial, ethnic, or religious slurs), illegal drugs/controlled substances, or illegal activities."
in·nu·en·do
An innuendo is a remark or question, typically disparaging, that works obliquely by allusion.
Above is the portion of Microsoft's Online Policies which Microsoft claims Mr. Gaywood violated along with the definition of innuendo.. While Microsoft cannot possibly be faulted for retaining control over how to monitor and address problems within it's Xbox Live community, it must be held accountable for any discriminations it promotes. Based on the account thus far, Microsoft not only condones, but oversees and encourages flagrant homophobia.
According to Microsoft's own rules, a user may not create a Gamertag which: a) looks like, b) sounds like, c) stands for, d) hints at, e) abbreviates, or f) insinuates a category of prohibited terms. Only a) applies. The question is thus: what did Mr. Gaywood's Usertag "look like"?
Here, according to Microsoft's own rules we have several categories: a) profane words, b) sexually explicit language, c) sexual innuendo, d) hate speech, e) illegal drugs f) illegal activities. Right off the bat we can exclude a, e, and f. B does not apply since "gay" alone is not sexually explicit - it is the term used to describe one's sexual orientation or sense of happiness. This alone is not explicit. This leaves two options: sexual innuendo, or hate speech.
This is not sexual innuendo. In order for there to be sexual innuendo there must be an intimation about a person or a thing. This isn't wordplay, this is fact. There must be an intent. There is none here. There must be a reference to a sexual act. There is no such act here. This must be at least somewhat apparent. Calling something "gay" in itself is not innuendo.
It's obvious the conclusion that Microsoft has arrived at - the same conclusion it's Xbox Live members are notorious for: the term "gay" is hate speech. It is derogatory for homosexuals. Nevermind that millions of gay men and women take pride in using the term "gay" as label for themselves. Oh, no. I understand banning the words "fag" or maybe even "queer." We've heard the typical stories of playing on Xbox Live. It's filled with "you're so gay," "that's gay," "quit being gay." THESE players use the term disparigingly. Apparently Microsoft agrees with them. "Gay" means bad in Microsoft's eyes and there is no other interpretation.
Nevermind that Microsoft completely turns their back on the LGBT community. Nevermind that someone isn't permitted to use their OWN NAME in their tag. Nevermind that you're not allowed to proudly express your sexual orientation in a non-graphic, non-sexual manner. Nevermind that at this very moment, a good chunk of their users are proliferating hate-speech in a far more graphic and visceral manner via their headsets. No. Microsoft has deemed that "gay" is wrong, in any capacity.
Congrats Microsoft. You've completely lost the point on this and have gone in the exact OPPOSITE of what would have been appropriate. You've sided with the sadists, the immature, the pinheaded, and the homophobes. You've lost my respect. More importantly - you've lost a (straight) customer. - kinstray, on 05/22/2008, -20/+167"Gamertags are visible to everyone and it would be hard for me to defend to a parent of a young child who saw it that the name did not contain content of a sexual nature."
Yeah, then the kid goes away and kills a hooker in GTA IV before killing a few cops and collecting drug money. How will the parents cope with a gamer tag like that? - sleepwalkers, on 05/22/2008, -20/+143....really? Even Richard Gaywood isn't nearly as outraged as you are.
- inactive, on 05/22/2008, -4/+74If my name were Dick Gaywood, I'd not only change my gamertag, I'd change my name.
- aadsm, on 05/22/2008, -4/+73"Gamertags are visible to everyone and it would be hard for me to defend to a parent of a young child who saw it that the name did not contain content of a sexual nature."
Well, then he shouldn't have any contact with any children whatsoever, just imagine when he introduces himself! please someone think of the children! - Noriv, on 05/22/2008, -1/+61Because of this story: http://digg.com/xbox/Xbox_Live_Bans_A_Guy_For_Usin ...
- bossm4n, on 05/22/2008, -9/+68Microsoft dropped the ball...uh wait...they really screwed the pooch...no...Microsoft *****...damn...gay.
I'm changing my XBL name to Mike Hunt. Yell that across the room when mom asks who you're gaming with. - blacklilyninja, on 05/22/2008, -11/+63corporations lose intelligence at the same rate they grow in size.
people are idiots in general - jezsik, on 05/22/2008, -3/+54Waitaminute! Isn't Microsoft's own name full of sexual innuendo? I mean, c'mon, how awful would it be to overhear a couple of coeds looking you and hearing them whisper "So that's Mr. Microsoft!" and then giggle?
- inactive, on 05/22/2008, -19/+69"it may not be obvious to other Xbox LIVE members. In this case, a complaint was filed by a member of the community"
wtf..? and anyway why would a kid know what gay meant anyway, if they didn't know the word they'd just ignore it, this is pathetic! It's not like his name was 'Rampant Mcbuttdiver' or something - buddamus, on 05/22/2008, -8/+58Politically correct gaming sucks. I want to shout ***** YOU as I shoot someone in the face with a BFG
- mattysan, on 05/22/2008, -2/+51This guy should feign stupidity and make his second gamertag DickGaywood.
- erikislame, on 05/22/2008, -11/+60So MS bans gamertags involving "comments that look, sound like, stand for, hint at, abbreviate, or insinuate illegal drugs/controlled substances,"?
Guess they have to ban 40% of the subscribers.
Rather than sacrifice that userbase, Microsoft will probably just get pot legalized in the US. That seems easier. - Pinkshisno, on 05/22/2008, -0/+41dugg for Rampant Mcbuttdiver.
- DemDude, on 05/22/2008, -5/+46What's so bad about sexuality?
And what would happen if my name was Jack Heterodude or Jimmy Straightwood? Would that be considered offensive? America is full of hypocrites... - Jonmad17, on 05/22/2008, -3/+44Just encase you're to lazy to read the story the guys actual name is Richard Gaywood, it wasn't a pun. Can you imagine the ***** he went through as a child?
- Myonosken, on 05/22/2008, -5/+43Microsoft are having to act based on their own TOS because some sad ***** is reporting every name with 'gay' in it. Start reporting things like 'ULTRASTRAIGHT' and then we will see where Microsoft stands.
- h3smith, on 05/22/2008, -12/+47Lets ban a guy using his real name, but lets not ban all the 12 year olds yelling racial epithets into the multiplayer. Good job MS!
- grungegbunny, on 05/22/2008, -3/+33Richard Gaylord is SOL too. Wonder what happens when Andy Dick wants to play?
- XIUgraag, on 05/22/2008, -7/+32People, he wasn't banned, he was just asked to change his name...
- JudgeMonkey, on 05/22/2008, -2/+26You may not believe this, but there actually ARE some parents that monitor their kids on live and don't let them play GTA. Yes, I know. Go into any online game and hear the shrill voices, still though, this GT is just as visible in Viva Pinata as it is in GTA.
- evilangela, on 05/22/2008, -2/+24From the Xbox Live Code of Conduct:
"Don't give out information that personally identifies you (such as your real name, address, phone number, credit card number, etc.) while you're playing. This includes voice chat and the names you create for your gamertag or mottos. This information could be used by other players for illegal or harmful purposes. Also, don't give out the personal information of other players."
Looks like by using his real name as his gamertag, he's violating the Code of Conduct, which alone is justification for forcing him to change it. - seobro, on 05/22/2008, -2/+24The situation is most queer.
- 8BitGaming, on 05/22/2008, -0/+21Is Dick Herts not among us today?
Who's Dick Herts? - DeFex, on 05/22/2008, -1/+22I like to get people kicked from wordkick servers by asking "whats the part of a plane the pilot sits in"
- Stopher, on 05/22/2008, -2/+22Wow, the actually charge for changing your username. That's obnoxious.
- hklrs, on 05/22/2008, -8/+28So what? It was an excellent analysis.
- ooby, on 05/22/2008, -3/+22"What did Mr. Gaywood's Usertag "look like"?"
Does Mr. Gaywood's Usertag look like a bitch? - ouzome, on 05/22/2008, -7/+25What a gay reply
- estvir, on 05/22/2008, -2/+20Because every child plays GTA IV.
Idiot. - WNW3, on 05/22/2008, -6/+23He wasn't asked, he was told. Big difference.
- Serris, on 05/22/2008, -0/+16Black people offend the KKK. Should we ban black people from XBox Live? Muslims offend white rednecks. Should we ban Muslims from XBox Live? Republicans offend Democrats. Should we ban Republicans from XBox Live? Democrats offend Republicans. Should we ban Democrats from XBox Live? Given the negative score of your post, you offend Digg. Should we ban you from here?
I believe that pandering to Bible-beaters that think that two men are committing a sin by holding hands is wrong and offensive. ***** those Bible-beaters, ***** any 'concerned' parent who has so much difficulty talking to their kid that they would sooner complain to a faceless corporate entity to solve their problems. And ***** you too. - inactive, on 05/22/2008, -5/+21"wtf..? and anyway why would a kid know what gay meant anyway"
Not all kids live under a rock, retard - VinceNoir, on 05/22/2008, -3/+18It's finally happened. Just like in the Douglas Adams HHGTTG radio series, where the Dolman Sax Shoe corporation claimed that the reason their shoes cause blisters foot sores and debilitating foot conditions was... "your feet are too big for your shoes". Ridiculous.
And yet again, while it's unacceptable to have an innocuous name like "Gaywood" as part of your online identity, it's probably perfectly fine to have "TheRavager", "KingFragster", "KillEmAll", etc... We're so ***** up as a society. It's ok to watch a guy getting his balls kicked on TV, but it's not ok to see him getting them stroked. What kind of message is the western world sending to humanity? - dood, on 05/22/2008, -2/+17"Daddy? What's Gaywood?" "That's just his name, child."
I don't know, that makes too much sense. I think I'd make a terrible parent. - cJw314, on 05/22/2008, -1/+16Actually, the NAME *was* banned... HE and his account were not.
- WhiteIce89, on 05/22/2008, -0/+14What's a shorter way to say Richard? Oh yeah...
Dick Gaywood. Could've been worse *snickers* - musicbear, on 05/22/2008, -2/+15You did well up until the last 10 or so paragraphs. The innuendo you're looking so hard for is "dick gay wood". Not the idea of "MS thinks the word gay is hate speech". So close, and yet so misplaced! MS also can't take the time to evaluate each little 10 year old douche bag gamer tag as "real" or "offensive". If it's typical of the wording a 10 year old douche bag would use while attempting to be "naughty" then it's going to get banned. Sorry if it's your real name. There are Asians with the name Phuck. I think that's gonna get banned too.
- Llanowar, on 05/22/2008, -2/+15I wonder how many gamers have "straight" in their name?
I bet they won't ban those. - newms32, on 05/22/2008, -10/+22So you're aghast that a "dick gaywood" could possibly be taken as innuendo? Yeah you're kind of dumb
- LimeParrot, on 05/22/2008, -2/+14I think this is being blown out of proportion...
- orion846, on 05/22/2008, -1/+13in YOUR endo..... oh ya....
- matschig, on 05/22/2008, -4/+16No it is funny, just like the name Dick Gaywood.
- richardgaywood, on 05/22/2008, -0/+11But then I'd lose all this internet fame I'm currently basking in!
- Reziarfg, on 05/22/2008, -2/+13Are you retarded?
- TremorX, on 05/22/2008, -2/+12Nannying users names is far less important than the other ***** that goes on XBL. I'd pay $25 a month if it meant they'd permanently ban anyone who says "hey guys can you help me get achievements" before a match starts.
