It's NOT and "upgrade" or "expanded features" like they play the XP2 service packs off for Windows when they change license terms and absolve themselves of all liability. You MUST have the patches they require in order to play on the service, it's in the TOS. Therefore Microsoft MUST accept responsiblity if you have not modified the console... which only a small number of people actually do. Like another poster said, they can't hide behind "hardware vendors", driver problems, ISP problems... the WHOLE lot is theirs... THEY have to make it right!!!

Next, the crashing gradually became more frequent until it would crash as soon as I played any game... without fail. Now, it's giving me the three red lights (with an error code of 0102). I don't know if it is defective hardware or if the updates triggered the downward spiral.

- debbiedragon, on 10/12/2007, -1/+12I know that our Xbox 360 (we got it the day it came out) was screwed up within the first 90 days with the flashing red error lights or whatever, and failing to read discs. Originally microsoft made us pay to ship it and pay to have the thing repaired, over $130. A couple months later we received a check in the mail with a note that said "It came to our attention that you were right, your repair should be covered under warranty". So I think that something might come out of this guys class action suit.

When they FORCE you to download patches for their system, their hardware, their code that's locked down so you can't touch it. When it bricks it's ENTIRELY their fault!
PC makers and Microsoft have played the blame game for years... it's "their" hardware, or "their" drivers, or "their" OS.. and on an on....in this case Microsoft has locked down the ENTIRE channel. They manufacture the hardware and DRM it, they write the firmware and DRM it, They require game makers to publish games thru THEM and then DRM it... seeing a pattern.... to get on line you have to connect to Microsoft's servers, with DRM... YOU must allow Live to apply their patches to update the DRM... even game makers have to run THEIR games on Microsoft's Servers so Microsoft doesn't have to share the DRM. - dandonia, on 10/12/2007, -0/+6I dont think they should get away with selling a product that brakes within the first few months(everyone knows someone with the 3 red lights) anyway but then to release a patch that causes more computers to break and then charge many of them people to repair the system. Thats ludicris. This happened to me just after i got smackdown which is the sole reason i bought the 360, I had enough time to go through the story build a charactor unlock nearly everything. I won 6 prestigus belts online i was 3rd in the rankings and then to loose my 360 for nearly a month, and when it came back to me with non of my xbox live content or any of my saved games. It has ruined the only reason i even bought the console for me. I dont want to do it all again but now i have to and i will never get the ranking back. This was on of 6 games ruined for me so Microsoft should pay somet.
What if instead of the 5million they are going to pay out, if they just gave away a free game to us. It could be a game from xbox live or even microsft points. It would keep people playing on their systems and make me feel better about what happened to me.

When i sent my 360 back to microsoft they didnt tell me to keep my hard drive so now i have lost all of my saves and it has put me off playing most my games simply because i was so far through them an i dont want to do em again.

In this case the USER is contractually not allowed to modify their Xbox software.. the entire show is Microsoft.. the hardware, firmware, even the games and internet servers are all operated and controlled by Microsoft. There is no third party software on the system NOT somehow verified by Microsoft! NONE! That makes this WORLDS DIFFERENT THAN WINDOWS SOFTWARE.
Microsoft can't hide behind EULAs like they do with Window and PC software. It won't hold up in court. I it's not OPTIONAL to install Xbox patches... they are required under the TOS contract. They can't say "oops" we bricked your device (you took a risk with new software, better luck next time) like they do with every Windows Update... It's entirely their system and it's for one purpose, not many. With all the DRM and all the ways they make people PAY to use, pay to distribue, pay to write games... that makes it squarely MICROSOFT'S fault when the thing doens't work. Xbox is effectively like a Cell phone.. Their profit... and their Blame.

He was without the console for about a week, but that was it. From what I can tell, Microsoft is refusing to give free repairs to people who have been modding their consoles. Even if the problems are unrelated, I can understand Microsoft's reasoning - the people modding their consoles know that it voids their warrenty, and so by doing so knowingly take on the associated risks.
