Konami Issues Patent Lawsuit Against Rockband

wannabegamer.com — Konami has recently filed a lawsuit against Harmonix, MTV Networks, and Viacom alleging that Rock Band violates patents that were filed in 2002 and 2003.Almost a decade ago Konami came out with a Jappenese arcade game known as GuitarFreaks.

That just means the intellectual property rights on the controller are very specific to the way it looks, and not its utility. So you would have to almost copy the design exactly to be infringing. A design patent is just a few perspective drawings of your invention. A lot of people file design patents applications when their utility patent applications are rejected because they are so obvious.
