The Gamestop corporate agent then began to explain to him how one of the orders had to be cancelled because it was only one per family.
My brother is 13 years old. He doesn't know how to argue his position properly. He ends up just letting this cancel his order and leaving mine. Now I have a really disappointed little brother. I am 24 and live in my own place. This is ridiculous. I took him with me and we lined up at 4am just to be sure we would both have a PS3.
This is not going to happen. I called the Gamestop manager after corporate called my brother. The local Gamestop manager is a really nice guy, but he had already cancelled one of the preorders on Corporate's instruction. I explained to him that NONE of the documentation said it was one per family. I told him that I need him to get into contact with the district manager, and if he cannot get my brother's pre-order back, then I need to talk to the district manager directly. I will be speaking with someone at corporate regarding this. They cannot just change the rules AFTER the pre-order has been made completely legally.
If this issue does not get resolved by corporate, I will be pursuing a lawsuit. I do not know much about my legal rights, but I do know that what they are doing seems 100% illegal to me. If anyone else is experiencing this same problem, we need to keep in contact and get this taken care of. - Klever, on 10/12/2007, -9/+29Yeah I was with em until I read the link below where the poster admits in a forum that he isnt even a gamer and only plans to sell them on eBay. Granted Gamestop are no doubt dirty bastards for changing "household" to "family" on-the-fly, but posting a story saying "PS3 fans get the shaft" when in fact it should read "Non-gamer profiteers" is even more despicable.
I'm all for capitalism but come on guy, do you think people are going to give a ***** that you can't get three PS3s now that they know you are just planning to sell them on eBay??? WRONG.

Maybe they got into line late and then got upset because they didn't get one and so they made the whole thing up to make gamestop to look bad hmmm.
Maybe we should consider the easy possibility of that first.

What's causing problems with the PS3 is they only had 400,000 units available at launch. But Nintendo has been manufacturing Wiis for a while now and they are supposed to have a large number on launch day, 1 million IIRC. There should be no shortage problems and thus no hassles.

8:00pm the night before - get a call from the manager telling me our store was granted 16 systems which will be reservable, but that its a secret. No more than one system per household OR per 'group of people'. Only 2 of those 16 systems reservable by employees.
9:00am - arrive at store, look at line, wish I wasn't opening alone
9:01am - notice phone is ringing, constantly (have we EVER taken reserves by phone?)
9:30am - opening ritual completed, look in register OS, PS3 reserve sku not there (wtf?)
9:31am - call the store manager, no answer.
9:33am - call the store manager, no answer.
9:35am - call district manager, who tells me to call another store.
9:40am - realize other stores aren't answering phones due to constant customer calls
9:45am - call a friend of mine who tells me that GameStop fudged the previous night's register transmission, reserves must be put through 'manually'
9:47am - open store early to serve customers who then complain about the wait
9:55am - deal with older woman getting upset because she can't reserve two systems
10:15am - reserves are completed
10:15am until end of shift - answer calls from people asking if we're accepting reserves today, if they can reserve over the phone, bla bla bla.
GameStop customers are a pain. As self-entitled as any group of people you'll ever meet. The guy behind the counter in this story didn't have his system reserved first, if he was alone, because we can't process our own transactions. Furthermore being able to reserve a system, or even shop at GameStop, is a privilege, not a right. We don't get commission, bonuses, decent raises... that means we don't always feel like solving your every problem, especially when you're asking us to go against corporate policy (as written OR communicated.)

Here's my story I woke up at 7:45am (est) to wait in line i was the 8th person in line. At that time we had no clue as to how many they had at the store it could have been 2 for all I knew. Anyway at about 9am (the store opened at 10am) the manager came out and gave us all in line a list of all the games that could be preordered. We asked her how many the store had and they had 8. I was pretty excited to get one knowing i was the last one. So I thought. So at about 9:55am a guy pulls up and bam cuts everyone in line and gets first crack at the PS3 everyone in line was pissed and asking questions, the manager said that, "He had a prior arrangement with management that he was to get one first." That's all that was said. I got bumped and lost my spot for a PS3. Needless to say I was pissed as *****. Two reasons why I was pissed, first if she KNEW ahead of time that the guy had the prior arrangement why did she tell us they had 8 when really they only had 7? I would have made an effort to find a new store and waited there. Second, how can they have a prior arrangement with management to get one? He wasn't an employee of the store so how can this guy just cut everyone in line and be first. Something seems fishy with this whole scenario the way it went down. The most she said she could do was put me on a list that if "someone" doesn't show up then I could be moved up. AKA here's something to shut you up now go home. I was extremely upset/offended about all this. Do I have grounds to file a formal complaint against Gamestop? There were 7 other witnesses plus a pissed off mother there at the time. So my story can definitely be validated. I wasn't pissed at the guy at all, I mean hell if i had prior arrangements and could do that I would have done the same thing. I was more disappointed in the management/franchise that they would be so shady to a paying customer. Put it this way, I'll never shop there again and anyone I talk to I'll try to convince the same. Anyone got any advice for this or a similar experience?

I heard they were only banning auctions and accounts that had already put up the auctions. I guess the rule is that a seller must be no more than 30 days from receiving the item before they can post the auction. As long as they wait until a week or so before the launch to start the bidding, they should be ok.

I own a ***** VIdeo Game store (private store). Since Gamestop / Eb and every other ***** place is a Corporate owned business - I cannot own one.. SO i had to open my own VIDEO GAME LAND STORE.
To compete with corporate stores it is almost impossible - but i struggle to do it.
I've been contacting sony for Months tring to get some stock for launch. I contacted Distributers, vendors - all the right channels. when you own a Private business it is almost impossible to get stock of an item like this - with 360 i got squat untill april 06.
So I like everyone else had to go and pay RETAIL PRICE to get one... AND YES ONE!!! , know what Im going to do with it???... RESELL IT TO MY BEST CUSTOMER - the one who pays the most. Why - becuase I have a hard enough time staying in business.
I guess you can say im as Bad as the ebayers!!! ??? Well guess what - ebayers are not bad people - they are just people who like everyone else are looking to make money.

How does buying out all of gamestops stock (yes their stock - not yours you lonely troll employee slave) ruin business??... Once all 400,000 are gone they are gone. Sony don't give a ***** about where they go - they just care to declair - totaly sell out victory and sales supremacy of their console. So if you me or anyone else shell out $600+ dollars and decide we want to hock it on ebay to a person who will play it.. all 400,000 will still find their way into gamers hands - and guess what??? They will come to Gamestop / EB, Best Buy, Ebay and everywhere else (including my privately owned business) and buy games and accessories. So how does it ruin business.

IANAL. - DiggInDC, on 10/12/2007, -1/+5My contracts class are a little rusty, and obvi, I don't know the total facts of your case (or how the preorders work, I'm an xbox360 user), but here goes:
1. It sounds like you have a valid contract here with Gamestop for your ps3. Depends on the papers you signed--but it definitely sounds like there was an offer and an acceptance and consideration.
2. On the theory of contract remedies, I really don't think you could be able to get any money. I think the best you could do is get the money back you put down (if that was the case), and perhaps force Gamestop to give you a PS3 (a. you have to pay for it and b.if your suit moves that quickly before launch). Maybe the best that can happen under a contract remedy, is they grant you some kind of punitive damages (however, I really don't see it being all that much, unless the court is willing to make a point).
3. There may be other courses of action you may take (false advertisement, yada yada yada) but, none that I can think of.
4. These are just thoughts, not actual legal advice.
On a more personal note--that sucks. What a terrible position to put your family in, especially your kid brother who I'm sure was stoked for the ps3. F those F'ers. - Combathangar, on 10/12/2007, -5/+9Kinda hard to feel too sorry for these guys.
What do we know....not much, no actual names provided in the whine post. I can sure have empathy, but 3 brothers go to one store and wonder why someone thinks its not good for customer relations to let them all have preorders......if they had all 3 gotten their consoles, then Im sure there would be a story being dugg about how EB/Gamestop had let 3 obvious brothers take 1/3rd of the available preorders or somesuch nonesense.
It was at best a poor idea for three brothers to show up at the same store for obvious and predictable reasons. How would you feel if you were 16th in line at a 15 preorder store, and there were 4 sets of three brothers in front of you? It may suck, but the outcome was predicatble, and in the end, it is the right decision by the store, although it should have been made very clear at the time of 'preorder' that your attepts to get 3 systems was unlikely to be honored.
My opinion may not be popular, but I can only say what I think is right in this case. The company put out a letter stating one thing and then back tracks and says something different. Not to offend, because I have bought plenty of games from Gamestop, but Gamestop is wrong. From a PR standpoint, they are going to burn.
