Circuit City Refuses to Honor Call of Duty 4 Deal
news.filefront.com — "Today, like many anxious gamers, I went to Circuit City (Store # 3111) to pick up the highly anticipated “Call of Duty 4″ for the XBox 360. I chose to pick it up at Circuit City as this week’s circular ad listed a free copy of the previous game “Call of Duty 3″ with purchase. When I went to check out, I was told that it was a misprint..."

- grimhammer00, on 11/08/2007, -8/+2Isn't their a clause or something that they will meet the lowest price of any competitor +10% less? Never mind...I have no Idea where I was going with this.
Just check the fine print and see if they have a legal right to refuse their own flyers...I'm sure they do, but you might get lucky?- xOpifex, on 11/08/2007, -0/+12When I used to work at Circuit City our managers would have us put out "add correction" notices if there ever were misprints, and I think legally that's all they have to do. If they didn't have any sort of sign in the store stating that there was a misprint they can probably be held legally accountable.
- finnor, on 11/08/2007, -0/+3yeah, thats how it is still, they have to leave a sign up in merch or at the csa's desk, but some people might be lucky enough to get their ad signed off as a raincheck kind of if an associate+manager is willing so they can come back and get cod 3 when its in stock again.
- cdahlkvist, on 11/08/2007, -1/+17That doesn't explain why they don't correct their website though. I looked at 3 of my local Circuit Citys and they all list that as their ad on the website.
Makes you wonder if they do this just to get people to come in for the deal figuring they will still buy it if the store renigs since they are already there.- MarkOfTheDead, on 11/08/2007, -1/+13Bait and switch. Someone's gettin a fine.
- brstilson, on 11/08/2007, -2/+2All retail stores pledge to match their competitors' prices. It's an empty promise because they will often only match the exact model number, which is almost never the same from store to store, even for the same items. PC manufacturers will often have different model numbering schemes for different stores even. HP ends all of it's Wal-Mart product model numbers with a "v" for example.
- 1shawn, on 11/08/2007, -0/+5That first statement isn't completely true. Target for example does not price match, even if it's the same model number.
- mrurc, on 11/08/2007, -0/+2They don't have a legal right to refuse to honor their own advertisements in cases of false advertising or bait-and-switch. In this case, bait-and-switch is pretty applicable, because they baited with a combo pack of two games and switched with a single game.
However, if it says "where valid" or "in participating stores" all bets are off.- sexybobo, on 11/08/2007, -0/+2Or if it says "all prices subject to change without notification"
- djphatjive, on 11/08/2007, -0/+3Got mine, Went to 2 stores here in colorado and both of them were handing out Call of Duty 3 like cookies. Had a box of them.

- crimsonnblue, on 11/10/2007, -3/+50You know what this reminds me of? Remember when Pepsi had a promo going on where you collect Pepsi points. On one of the commercials had a kid which was show with a fighter jet and it said like 20 millions Pepsi points or something. Some guy actually collected that many points and sued Pepsi for false advertising because they wouldn't fulfill the request.
- scrimaxinc, on 11/10/2007, -0/+23Except it had fine print in the commercial stating that the jet wasn't a real prize. I remember that ad and all the hype it caused too, but this isn't the same thing.
- SoonerBluff, on 11/10/2007, -0/+18yes he did... and he lost in court, Pepsi didn't have to buy him one. (compliments of bathroom reader)

"I wanted to ask about the 'guarantee' you place in your ads, the one that says if a game isn't in by 2pm the day of release you get a $25 gift card. A few weeks ago you guys didn't have Skate in stock on release day, and I was rejected my gift card because it was a printing error. Printing error or not you should live up to your 'guarantee', I didn't complain then, but yesterday afternoon I went to pick up Call Of Duty 4 for the PS3 at 2:05 (I took off work early for this).
The customer service is horrible at the Elk Grove location, I was waiting at the videogames section waiting for someone to help me for over 5 minutes, it was another customer that told me they were holding the games at customer service. So after waiting in the customer service line for another 15 minutes I was finally told by a (pretty rude) employee that they were already sold out....Sold out in 15 minutes!? I then ask "Well don't I get a $25 gift card then, since you guys guaranteed to have it by 2pm?" And the employee tells me "well we did have them, we just don't have them now."
What's the point of that guarantee? I then drive over to the Best Buy that's across the street and they had literally over 50 copies of the game in stock...I think your employee was just being lazy because he didn't even check if the game was in stock. I'd really appreciate my $25 gift card, it's not fair that those ads trick people to come into their store, realize the game isn't there and then leave empty handed."- raynar, on 11/08/2007, -21/+3You took off work for a video game? I'm at a loss for words...
- BobsYourUncle, on 11/08/2007, -0/+19Some of us have flexible schedules. Take off early one day, make it up the next. It's not that new.
- raynar, on 11/08/2007, -20/+2yea. but its just that you left to go get a video game. laughable.
- Echuta, on 11/08/2007, -1/+10Why is that more laughable than taking off early for any other hobby? I work to live, not the other way around.
- alecks, on 11/08/2007, -0/+11Some of us take off of work to destress and have fun.... you might enjoy sitting on the beach doing nothing, others might enjoying going head to head with their friends online in a videogame. don't judge
- mywhitenoise, on 11/08/2007, -3/+1I didn't take off work, I made that part up. I actually got there at 6pm. Everything else is true, though.

- Talena, on 11/08/2007, -8/+2Does anyone care?.................
- Nobi-Wan, on 11/08/2007, -0/+3This same deal was with the new Tony Hawk. You could pick up Project 8 for free if you bought Proving Ground. I think this was a few weeks ago.
- BearinG, on 11/08/2007, -0/+2So obviously its a "common" deal for them
- themastersb, on 11/08/2007, -0/+1When places pull a bait and switch make sure not to buy the item there and go to Walmart instead or something..... going to Best Buy instead may be just as bad.
- grimhammer00, on 11/08/2007, -8/+2Isn't their a clause or something that they will meet the lowest price of any competitor +10% less? Never mind...I have no Idea where I was going with this.
- airwalkery2k, on 11/13/2007, -2/+305I'd like to see somebody defending that as a misprint:
Yeah... It's a misprint... it was really supposed to say "Buy Call of Duty 4 and you get to enjoy that same copy of Call of Duty 4 extra hard for free." And the bottom part was really supposed to be another picture of Call of Duty 4 and it was supposed to say "Free extra fun" at the bottom. You know, common typo.- iammustangman, on 11/10/2007, -0/+25it can't be a misprint when they effing honor the deal online!!!
i just bought it online, today, with the deal ( for 59.99 -29.99 discount + 29.99 for CoD3)
this is an utter crock of ***** to everyone who went to b+m and got shafted. boo on you cc - aerogant, on 11/08/2007, -1/+5I can't see how they can say it is a typo, when it even says it on their online store
http://www.circuitcity.com/ssm/Call-of-Duty-4-Mode ... - actionscripted, on 11/08/2007, -1/+2Perhaps the "misprint" was that it actually appeared in print and not exclusively in their online store.
- iammustangman, on 11/10/2007, -0/+25it can't be a misprint when they effing honor the deal online!!!
- dextrousm, on 11/10/2007, -1/+164Some misprint...Circuit City states the deal both visually and in writing in at least three places in that ad. It's a sad thing for Circuit City that nobody is surprised...
- thebaron2, on 11/10/2007, -0/+40It's even re-stated if you click for more details. http://www.circuitcity.com/ccd/productDetail.do?oi ...
At the top it says "• Free: Call of Duty 3 with purchase" and then below that it has a section for SPECIAL OFFERS, under which it says "• Free: Call of Duty 3 with purchase" again. How many times can you independently print the same thing on different pages and still call it a misprint? Someone get the BBB on the line.- Gudlyf, on 11/08/2007, -0/+5But that page also says "Not available for in-store pickup." So perhaps that means this is an online-only deal?
- djphatjive, on 11/08/2007, -0/+2Nope got mine at CC on launch day. Bought call of duty 4 and got 3 for free. Had a box of them they were handing out!

- logicalnoise, on 11/10/2007, -5/+54It's possible the mis print was that it would only be honored with pre orders but even so the numerous mentions of the deal means there's a viable lawsuit here.
- freezerburn819, on 11/09/2007, -20/+5people like you are one reason why america is getting out of hand. circuit city wont give you a game. yes, it was unfair. yes, its wrong on their part. did they take your money? damage your property? pain and suffering? anything?
if not, there is no case for a lawsuit PERIOD.
stop crying about everything and realize that people want to make profits, fairly or otherwise.- ghounds07, on 11/08/2007, -1/+6well circuit city did make the customers come to their store instead of a different store because the promotion sounded so good, so yes, they took the customers time / gas money. Thus circuit city may have stolen potential best buy/target/anystore customers which would probably make those stores angry..It's just weird the ad is so blatant in mentioning it, usually it is just a price mistake, this time they totally f'd up.
- bagelpirate, on 11/08/2007, -0/+2what about $40 small claim for the price of CoD3? Not every lawsuit is for a huge amount of money.
- jon30041, on 11/08/2007, -5/+2I like you, freezerburn. Kudos, and a digg to you. Because you're not a *****.
- Rsulliv1, on 11/08/2007, -2/+2Are you always this eager to defend people/places/things that are unfair to you and that wrong you?
- Khantusion, on 11/09/2007, -1/+2your logic is retarded. there's so many different degrees of injustice this could apply to. Having your retirement fund stolen out from underneath you? Yes, viable lawsuit. Not getting a video game that might or might not have been promised to you for FREE in addition to the regularly priced purchase of CoD4? Get a grip idiot.
- Rsulliv1, on 11/09/2007, -2/+1I'm glad there's some people out there so willing to draw this objective line for us all. I, on the other hand, feel differently. I believe that people were duped into going to CC because of this. As people have stated, other CC stores honored the deal. It's even more upsetting that a rogue manager decides to make his own rules up at the customer and the company's expense.
If someone put together a class action against this, and I was eligible, I would sign up. Even though that means that CC loses money (and even more respect), the people don't get much, and some lawyer gets paid big; I'd do it so that companies learn that they have to distinguish between a print error and allowing branches to independently interpret company policy.
Some people go the path of least resistance, other people are more idealistic. I don't really know which one is better...

- onlyclave, on 11/08/2007, -12/+4There is no viable lawsuit here. A newspaper ad is NOT a contractual obligation of sale. There is no bait and switch happening here. I bet if you look a little closer in the stores you will see the corporate-issued ad correction notice. These ads leave the desks of the advertising department 6 weeks in advance of print. Things change. Get over it.
- sancho, on 11/08/2007, -0/+3There are truth-in-advertising laws for people like you and companies like this. Circuit City is simply not allowed to advertise one thing and then change the terms when you get in the store.
- one2gamble, on 11/08/2007, -0/+4Thats completely untrue
- Drull, on 11/08/2007, -0/+3False advertising, look it up.
- bingobongony, on 11/08/2007, -2/+2No...YOU should. And actually read about what mus happen for it to be false advertising.

- spartyms2, on 11/08/2007, -0/+2You guys need to take a business law class. Onlyclave is right. The only time you have a firm offer with a newspaper ad is when the ad specifies a certain unit available or a quantity of units. Cry false advertising all you want, but that will never hold up in any court in the US.
- capotesan, on 11/08/2007, -3/+7There's a viable lawsuit? Over a video game that costs $20-$40?
That's worth taking to court.- sassafras1232, on 11/08/2007, -0/+4Two words..."Class Action"

@capotesan: So then, what's the cut-off? $100? $1,000? It was purposeful and illegal. If someone wants to pursue it, more power to 'em.- capotesan, on 11/08/2007, -0/+1The cutoff will differ for everyone. And I agree, more power to anyone wanting to pursue it. But if you're thinking of taking someone to court over a video game that you didn't get for free, you are an idiot.
I never argued that it couldn't be taken through the legal system. All I'm saying is you're stupid if you're even thinking of clogging up the court system with stuff like this. - koick, on 11/09/2007, -0/+1This is exactly what small claims court is for!

- ColorBlind, on 11/10/2007, -40/+15I just purchased an HDTV from circuit city and only have good things to say about my experience...they even honored their "we'll pay the difference if you find it cheaper." I found my TV 60 bucks cheaper at Sam's Club, a member's only store, and they still honored the price difference!
- supafuzz, on 11/10/2007, -7/+27What does have to do with this "misprint"?
- ColorBlind, on 11/08/2007, -3/+8If you would have read the article you would know...
- screwzluse, on 11/07/2007, -1/+2That's commendable but very surprising. I know that stores like Best Buy, Staples, Circuit City, etc, many times, have different models than Sam's Club and other club based businesses so that they can't be price matched. For instance, HP sells a 6280 printer at Best Buy and such but at Sam's or BJ's, I believe the model is actually 6240 or something like that. I thought that extended to TVs too.
- insensible, on 11/07/2007, -6/+1Hey this is really cool although i have been given the same option bu them a couple of times but never bothered to avail it .. but now i will definitely take care !!!!
- Xondar, on 11/07/2007, -0/+1How much did your HDTV cost? I'm not surprised you got goods customer service for a big ticket item. Especially when they might make commission.

- CyberSally, on 11/10/2007, -0/+34Some people did receive this deal. On the FW forums there is a huge thread about how they were getting both for $30. I am pretty sure it's dead now though.
- thejoka, on 11/09/2007, -0/+8I work at a Circuit City in Michigan and when we rang up both games, it discounted the price of CoD4, so yea everyone who bought it from stores in our area got them both for $30. But as finnor says below, we only had about 5 copies of CoD3, so once those were gone we were told to tell people it was a "while supplies last" deal.
- Murphinator2000, on 11/07/2007, -2/+0If you go to circuitcity.com and add both Call of Duty 4 and 3 for XBOX360 it totals $59.99
- modifiedbears, on 11/07/2007, -0/+1Yea I was one of the people who got both games for $30. There was a pricing error in their system so the solution was to just not honor the deal. I read in a post that they couldn't go in and change the deal during business hours.

- nnagflar, on 11/08/2007, -4/+12I'm supposed to think folks? Or, did you mean to put a comma in there?
- Zaneris, on 11/08/2007, -8/+2Actually, you're wrong, he was right. Using "think, folks" would imply to think of "folks". "Think folks" implies nothing more than people should merely think in general about what they're doing. It's called semantic drift, a good example is when something is "on fire". Break that phrase down and, think about it. ;)
- sancho, on 11/08/2007, -2/+4http://www.wikihow.com/Use-English-Punctuation-Cor ... disagrees.
"Use a comma when making a direct address. When calling one's attention by name, separate the person's name and the rest of the statement with a comma. Note that this kind of comma is used rarely in writing, because this is something that we do normally while speaking."
Although the example they use starts the address with the name, the rule doesn't change if the addressee comes at the end of the sentence.
"Amber, could you come here for a minute?" and "Could you come here for a minute, Amber?" are both correct forms. "Think, folks," and "Folks, think," are likewise both correct. - brentinkc, on 11/08/2007, -2/+4Wow. Just...wow.
- mrurc, on 11/08/2007, -0/+2In addition to Sancho being correct, the correct grammar for think followed by folks where you want people to think of folks is to include no punctuation between them or to include a colon or dash between them. I would go with no punctuation myself, since colon denotes "as follows" and dash is more appropriate for phrases:
"Think folks!" is a car dealership slogan
Think-- folks is a car dealership.
Think: because folks is a car dealership, they make money selling cars.
"Think, folks" addresses folks and instructs then to think.
- sancho, on 11/08/2007, -2/+4http://www.wikihow.com/Use-English-Punctuation-Cor ... disagrees.
- sancho, on 11/08/2007, -0/+4Zaneris is simply wrong. I hate to be a grammar nazi, but when you're spreading misinformation rather than just using the words incorrectly, I have to draw a line.
In that sentence, "Think" is a command, and "folks" is the target of the command. In this case, you put a comma between the two words.
If you want to say "think of folks" you say "think of folks." I'm not aware of any circumstance where "think folks" is grammatically correct.

- reknaps, on 11/11/2007, -0/+12I got my PC version from Best Buy with a free copy of Behind Enemy Lines on DVD.
I wonder if thats the sort of deal they meant to print (if this is indeed a misprint)
btw... the game is bad ass - basic0, on 11/10/2007, -5/+183"When I went to check out, I was told that it was a misprint"
That's when you respond: "Well, I'm sorry to hear that. In the future you should try to avoid those sorts of errors. I'll take my free game now please."- dfdemar, on 11/10/2007, -4/+32And then they'll laugh at you.

- onlyclave, on 11/08/2007, -19/+6And then you go to jail where you are traded for a pack of cigarettes so someone else can ***** you in the ass. That was worth an ad misprint, wasn't it?
- SnuKs, on 11/08/2007, -4/+9Or you can get a sense of humor.
- mhuggins, on 11/08/2007, -2/+1I thought it was funny, onlyclave.

If you refuse to honor this price I will be forced to call the Better Business Bureau about you, so you can get reported for failing to honor your stated prices AGAIN. NOBODY CHECK OUT WITHOUT VERIFYING THAT YOU ARE PAYING THE STORE LISTED PRICE FOR YOUR ITEMS!"
That's like calling management on the intercom.
- brentinkc, on 11/10/2007, -1/+52And then you start a fire to show them you mean business
- j4200, on 11/08/2007, -6/+7Or how about thats when you say "Alright, i came to CC because of this offer. It was out of my way, and now I will not be giving you my hard earned dollars at all."
Then you leave.
Unless of course you want to show them real good by paying extra angry this time. Then you have your crack.
I really don't get this obsession with owning brand new games. I've always bought games once they've proven themselves. Its rare I'll buy a game on launch. It seems like fiend behaviour to me. - Zuggy, on 11/10/2007, -0/+10Actually if I remember correctly, unless they have some sort of printed retraction they legally have to honor it.
Of course whether or not they have to you can just say they have to legally honor it and it may get you a little further. I know it's worked for me in the past- bingobongony, on 11/08/2007, -2/+2you remember INcorrectly
- joegibes, on 11/10/2007, -0/+3That's when you ask to talk to a manager. And when he says no, you just complain more until they either give you something or throw you out of the store.
- BearinG, on 11/08/2007, -0/+1You just pick up cod4, ask for cod3 too.. then make them scan cod4 and hold onto cod3 "im not sure im getting this yet".. and then leave with both.

- finnor, on 11/10/2007, -1/+44you pretty much got lied too. i work at store 0409 and it isnt a misprint, the only thing with our store is we only had like 3 cod 3 in stock, so i didnt get there in time :-(

- timfitz99, on 11/10/2007, -0/+17It's not a misprint, it was also clearly printed on their website as a bundle. It was even on the front page 4 highlighted deals on their website.
I think they changed their mind after a glitch in the system amounted in many people getting both for $30. I personally got COD4 for $30 at CC since they were out of COD3. They ended up taking a bath on that.
On the bright side, try to get the ad price matched at Best Buy. COD4 is fantastic! - Carsonauto, on 11/10/2007, -20/+8Off to torrent it I go.
- Polly, on 11/10/2007, -4/+6Because you were totally gonna buy it in the first place. Then Circuit City happened! OH NO ***** THE MAN! TRYIN TO KEEP ME DOWN!

- Ashkc88, on 11/10/2007, -0/+9Torrent it? What are you proving by punishing the developers of a game because a retail store doesn't honor a deal? How about I kill a kitten that has nothing to do with you, just because your name starts with a C.
- Shawn4168, on 11/08/2007, -18/+12This is simply one store, yet the title blows the issue out of proportion to imply that all Circuit City stores are refusing to honor this. Nothing more than sensationalist crap. Buried as lame.

- JoeFlambe, on 11/07/2007, -8/+2circuit city? pfft! why on earth would you buy anything there? I don't remember the last time I bought anything there. Was it really a misprint or they probably didn't have the previous game available.
sounds fishy to me, lucy. - trogdorBURN, on 11/10/2007, -2/+12They honored my deal, but they didn't have COD 3 in stock so they gave me a raincheck. Anyone else?
- gamabunta, on 11/08/2007, -1/+7Circuit City does not give rainchecks. It's company-wide policy. You are either lying or you got *****.
- trogdorBURN, on 11/12/2007, -0/+1Well I didn't check back on it yet, so who knows. I do have a physical raincheck though.
- Portwineboy, on 11/09/2007, -0/+4The CC on Union Sq. in NYC ran out of COD3 copies before I got there and told me there was no raincheck or anything else. Since I already own COD3 I didn't really care and was happy to get COD4 without putting up with the Gamestop, "wuh? you didn't pre-order?" garbage.
- thanakar, on 11/09/2007, -9/+3Quit bagging Gamestop for doing their job. You don't like the preorder spiel just don't shop there.
- sancho, on 11/08/2007, -0/+4Uh. That's exactly what he did. What's your problem?
- TotalHalibut, on 11/08/2007, -4/+1I must agree with thanakar. Aggressive pursuit of pre-order sales is a time-honoured and completely sound business practice employed by all major game retailers. It's also often required to ensure sufficient bargaining power with the distributors in order to get enough copies and a good enough bulk deal for you and the business. Now I can understand at the age of 13, good business practice might not be high on your list of things you know or give a damn about, but that doesn't mean it doesn't exist and your ridiculous 'rage against the machine'-style of thinking holds any water.
- Portwineboy, on 11/08/2007, -0/+1Oh get off your high horse. Child, I was thirteen in 1980. I'm sorry that my "wuh? you didn't pre-order?" comment was construed by you as "rage against the machine" but perhaps you should take a reality check yourself. To have the staff at Gamestop continually lie and tell you that a product cannot be found in ANY store, not just Gamestop, unless it was pre-ordered is a deceptive business practice and does nothing to foster a good relationship with the customer or the distributor. Jesus, I hate internet expert nerds like you.
- thanakar, on 11/09/2007, -9/+3Quit bagging Gamestop for doing their job. You don't like the preorder spiel just don't shop there.

- hsoj, on 11/08/2007, -0/+1I asked for a rain check at my circuit city but they said no.. :(
- BearinG, on 11/08/2007, -0/+1All they need to do is mention that its good til they run out of stock.. and just keep one copy for the sake of the ad. After that, they are home free. SOME stores will give you rain checks though

And judging by how the free offer appears in the ad, that is no way a misprint. - UtopiaInTheSky, on 11/11/2007, -1/+18I'm assuming you refused to purchase CoD4 after they told you the advertisement was false?

- crazyflanger, on 11/10/2007, -12/+5Circuit city is the devil. Has anyone read the article about the little old lady who worked for circuit city for about 20 years. Appearently she gets let go so cicunt city can hire teenages to harass all their customer from the moment they walk in the store. I hate best buy as well, but I'd still take best buy over cicuit city.
I've only purchased one item from circuit city. A samsung digital camcorder. All the digital camcorders had a display except the one I bought. I bought it because it was cheeper and had the same features as the higher priced sony model. I asked the sales guy if i could take it out and test it because there was no display. I was told "no". Then I asked about the return policy, I was told "14 days". I buy the camera, was unhappy with the quality of the video...but even more so that the camera didn't come with the remote that was advertised on the box or any software. I returned it and spent 2 hours trying to get all my money back. They wanted to charge me a 15% restocking fee. This restocking fee was never mentioned when I asked about the return policy. I know restocking fee's are common place now, thats why I asked about it. F**K CIRCUIT CITY. Thanks for reading my rant. - firelight69, on 11/08/2007, -1/+17I worked for CCity, and i know what happened. They ran out of COD 3 and the manager was probably just too lazy to take care of it. CCity employees have the ability to order from other stores, and should have gotten him a copy. Besides that CCity corporate would have sent out a memo which would have been posted near COD 4 if it was really a misprint. And CCity policy is to match any price advertised if there isn't a misprint memo posted near the item.
- ZooLi0, on 11/08/2007, -1/+1Employees cannot order games, music, or dvds from another store. Once the store is out they are out until they receive another shipment.

- tlm2021, on 11/08/2007, -10/+4Doesn't matter if it's a misprint or not. When you post a price, you must sell an item or that price. They posted that with a purchase of CoD4 you get CoD3 free. Even if it is a misprint, they still are legally bound to honor that deal.
- frenchtoaster, on 11/08/2007, -1/+13Actually no, no you are not. Advertisements are in no way legally binding in the wonderful United States of America! Thanks for assuming incorrectly though!
- mrurc, on 11/08/2007, -0/+1That is an over-simplification. Advertisements are sometimes legally binding but they are not contracts with the public. If the ads are false advertising or bait-and-switch, companies can get in trouble with the government. But they are not a legally binding contract with the consumer.
Saying that it is a misprint is an attempt to ward off false advertising allegations but considering the number of times it was printed that way, it seems unlikely to be a misprint.

- MAK1981, on 11/08/2007, -6/+3I agree, Circuit City is a horrible, horrible store. Oddly enough, all the teenage high school @ssholes that work there actually intentionally avoid you so they don't have to help. I was there first thing to pick up a $3.99 DVD and they didn't have any... I was the first one in the store. I was given a raincheck... and they never called back for when it came in. Nothing but bad news at that store, I don't even understand how it's still in business.

- writingismylife, on 11/08/2007, -2/+7Inaccurate. Well, not inaccurate that this guy got screwed, but its inaccurate that it was a misprint and that all Circuit City's are not honoring it. I just got my copy yesterday with my free copy of COD3, just as advertised.
- dshegle, on 11/08/2007, -0/+1Seconded. I got the deal and the poster -- no complaints.
- JJ2K1, on 11/08/2007, -5/+1I have not stepped foot into a Circuit City in several years now. Best Buy is the equivilent evil but I prefer them. If I ever want to make a large purchase of anykind, I go to Fry's. BB and CC rely on shoving their damn warranties down your neck to make a profit. Seriously, do I need a 2 year warranty for my pack of AA batteries?
- Ocelot13, on 11/08/2007, -1/+2when they die, take them back for new ones!
- mburgoon, on 11/07/2007, -2/+6Also the offer is still on Circuit City's website:
http://www.circuitcity.com/ccd/productDetail.do?oi ... - Snakedal337, on 11/09/2007, -6/+13I hate to kill you guys, but they dont have to honor it. Granted it's not good rep for the company, they are under no legal circumstances to say "Oh i'm sorry, here have this instead". Check the fine print. A company can void an entire circular if they wish. Not saying its right, but circuit city is just being your standard cheapass.
- NWAfellows, on 11/08/2007, -3/+2Incorrect.
And I'm not calling you out on this just to be a jerk, I actually work in the advertising / circulars industry. Typos on advertisements must be honored 100%.
Trust me, A LOT of attention is applied to advertisements before they go to press. In the event of a printing error, the company can sue the publisher/printer of the ad in an attempt to recoup some damages, but they must still honor the misprinted ad to consumers.
There is a little thing referred to as "puffery", basically exaggerated claims that a reasonable consumer would not believe, but that doesn't apply here.- finbec, on 11/08/2007, -1/+3"Typos on advertisements must be honored 100%."
100% not true. Did you get your law degree from a Cracker Jack box?
- finbec, on 11/08/2007, -1/+3"Typos on advertisements must be honored 100%."
- finbec, on 11/08/2007, -0/+4Not true....a company cannot knowingly extend an offer (or advertisement) with no intention of honoring it. It is called fraud or 'bait and switch', take your pick. A printing error is one thing, but your example is completely illegal and would result in civil action for any company. The fine print is irrelevant.
- cowboy86, on 11/09/2007, -2/+1NWA is totally right. Just because it's in a contract or a TOS doesn't mean *****. There are certain legal guidelines and standards in a contract that you have to follow that most do not. Don't let people fool you this way. Circuit City made an offer whether it was a misprint or not. These people showed up to claim this offer. Legally Circuit City has to honor this offer until they post a new circular or get the word out to the public that they are no longer accepting this deal. If they don't then buy it there, have the receipt and take them to small claims court. You will win hands down. Just make sure you have a copy of the add.
- finbec, on 11/07/2007, -0/+1You'll only win the case if the judge determines that the price/offer listed would have been a price that a 'reasonable person' would expect to be the correct price. In other words, if Ford advertised a car for $10, when the price should have been $10,000, you would not win the case. No reasonable person would assume a car would normally sell for $10.
All the other stuff you said about posting a new circular or getting the word out is BS.- mrurc, on 11/09/2007, -1/+1A reasonable person *would* think that when a new game comes out that the old tired version would be free with purchase if advertised repeatedly as such.
- finbec, on 11/08/2007, -0/+1True and I don't disagree with that. Circuit City is clearly in the wrong here....just not for the reasons stated by the other posters who are confusing people with BS. I was just trying to sort out the BS.
- mrurc, on 11/09/2007, -1/+1A reasonable person *would* think that when a new game comes out that the old tired version would be free with purchase if advertised repeatedly as such.

- miztaken, on 11/07/2007, -0/+2Come on, you can't tell us you got banned from Best Buy and not share with us why!
- astrotrain, on 11/08/2007, -0/+4Please share with us your legend of being banned from Best Buy, you really had to do something they hate... like tell customers the truth for instance...or tell customers they can get that product on line for a cheaper price.
- Sirocco, on 11/11/2007, -6/+8People still shop at Circuit City?
- astrotrain, on 11/07/2007, -0/+1.... and Best Buy.... .and Comp USA.... and....
- bingobongony, on 11/08/2007, -0/+1Yes they do.
- oOLiquidNightOo, on 11/08/2007, -0/+2i still go to circuit city for all of my rental divx needs.
- hybridcreation, on 11/08/2007, -0/+1You should have said "People still shop at stores?
I can't think of the last time I bought any electronics, games or music at an actual store.
- frenchkick, on 11/08/2007, -3/+2i actually did get the deal
and they did charge me 31 bucks for both games
i though it was the cashiers fault but i guess not
sucks not everyone is getting it though - Lehawk, on 11/08/2007, -2/+1Had a similar problem last year with Zelda (GC). They advertised it for $40 and it was to be released at 3pm. However, they kept making up excuses for why they didn't get the game in at 3pm, but every excuse included that it would be available 5 minutes before closing. Of course they did it so the employees would be able to buy it for 40, less discount and screw over the customers who wanted the one day price of $40. Thankfully, Fred Meyer decided to price match and I haven't shopped at Circuit City since.
- eatbeefjerky, on 11/07/2007, -0/+1Actually that's a little different... there is a reasonably good chance that the shipment just didn't show up. It sucks, but that's PROBABLY what happened in your case. Regardless, they should have given the people who showed up wanting Zelda rainchecks at least.
- dMinor04, on 11/11/2007, -2/+4circuit city is notorious for stuff like this (anyone remember the shadowrun and halo2 deal?). i already decided i will never set foot in that store again. i give them under 10 more years.
- astrotrain, on 11/07/2007, -0/+1If they keep these 'misprints' up...I lower it to two years, same for Best Buy... you walk in either store, you get no help, and everyone there is clueless about the stuff they sell. I went into Best Buy one time, asked for a casette adapter for my MP3, one employee looked at me like I was crazy, then took me over to a group of five of them, and they were wondering what I was talking about.
Never the less, I just left after the group of (now six) wanted to contact another person with inquires about that product.

"Circuit city is the devil. Has anyone read the article about the little old lady who worked for circuit city for about 20 years. Appearently she gets let go so cicunt city can hire teenages to harass all their customer from the moment they walk in the store..."
thats not just circuit city that does that, its pretty much all retail. a lot of companies hire people just to follow around long time employees to try and find any reason to fire them. the longer they work there the more money they make, the corperation rather hire new people at minimum wage than pay anyone with an hourly wage upwards of 20$. ive seen it happen to friends, ive seen it happen to people i work with, and no doubt if i stay in retail long enough it will happen to me.
anything to save a dollar...employees take on increasing amount of responsibilities and duties doing the work of 2, 3 sometimes 4 people. and are not even given proper training, because that too costs the corperation more money. they start off getting paid minimum wage, no benefits, not even a day of sick leave. by the time you put in the years of work to get a reasonable salary and maybe some benefits they fire you, and then youre forced to start at the bottom all over again.
the best thing you can do is support your local unions, support workers rights, and choose only to buy from stores and corperations who treat their employees and customers right.- veilrap, on 11/08/2007, -1/+2***** unions they make the prices even higher, moron
- BingoPower, on 11/08/2007, -1/+0Alternatively you could study at school and, in the words of that barenaked ladies song "never work a single day in retail".
- ptsd, on 11/08/2007, -0/+2yeah because its soo affordable to go to college and those interest rates are so ***** low....douchebag

- bblande, on 11/07/2007, -0/+3***** the BBB. The BBB has no real power.
Call the Federal Trade Commission. They're the one who can actually punish CC. - epj3, on 11/08/2007, -2/+1They just gave me a rain check
- lebruf, on 11/08/2007, -1/+5The problem wasn't the misprint, or their handling of it.
The problem was that you were shopping at Circuit City.- Sairgem, on 11/08/2007, -3/+2Oh, look, another "people still shop at circuit city?" post. Original. Funny.
I doubt many people here shop there often, but you'd have to be pretty stupid to pass up this deal. (If you actually have a store that will honor it)
